<br />94. <br /> <br />Regular Meeting <br /> <br />July 9,2001 <br /> <br />Page 5 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE RELEASE AND CONVEYANCE OF A <br />15 FOOT UTILITY EASEMENT ACROSS A PORTION OF PROPERTY <br />LOCATED AT 134 WEST HILLCREST DRIVE; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THE RELEASE AND CONVEY ANCE; AND <br />DECLARING AN EFFECTIVE DATE <br /> <br />Adoption of Ordinance on third and final reading: <br /> <br />AN ORDINANCE ALLOWING CERTAIN EMPLOYEES OF THE CITY WHO <br />HAVE TERMINATED PREVIOUS MEMBERSHIP IN THE TEXAS <br />MUNICIPAL RETIREMENT SYSTEM, TO DEPOSIT THE SUMS SO <br />WITHDRAWN, PLUS ANNUAL WITHDRAW AL CHARGES, AND <br />ALLOWING AND UNDERTAKING THE COST OF ALLOWING ANY SUCH <br />EMPLOYEE CREDIT IN SUCH SYSTEM FOR ALL SERVICE TO WHICH <br />SUCH EMPLOYEE HAD BEEN ENTITLED AT DATE OF SUCH <br />WITHDRAWAL, WITH LIKE EFFECT AS IF ALL SUCH SERVICE HAD <br />BEEN PERFORMED AS AN EMPLOYEE OF THIS CITY; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mayor Chiu introduced for consideration Item 11 removed from the consent agenda, <br />adoption of an Ordinance on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ADOPTING A REVISED SECTOR TWO PLAN; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PEN AL TIES. <br /> <br />Ms. Tatum moved for approval of the Ordinance on second reading and Ms. Hughson <br />seconded the motion. Mr. Mihalkanin moved to amend the last paragraph on page 4-2 to <br />read; Development proposed prior to these zoning changes should occur through the <br />Planned Development District provisions and Ms. Hughson seconded the motion for the <br />amendment. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Montoya, Hughson, Cox, Tatum. <br /> <br />NAY: <br /> <br />Chiu, Mayhew. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />The Council then voted unanimously for approval of the Ordinance on second reading. <br /> <br />Mayor Chiu introduced for consideration Item 16 removed from the consent agenda, <br />adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DIRECTING PUBLICATION OF NOTICE OF <br />INTENTION TO ISSUE CERTIFICATES OF OBLIGATION. <br />
