<br />181. <br /> <br />Regular Meeting <br /> <br />August 27, 2001 <br /> <br />Page 12 <br /> <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENTS ON BEHALF OF <br />THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mayhew moved for adoption of the Resolution and to amend Page 1 of the <br />Earnest Money Contract under Item 1 to provide a more complete property <br />description, Page 6, Item 12 to complete the blanks of Seller as Danny <br />Gribbon, Facsimile: c/o Gene Majors, 396-8539, and in the second paragraph <br />of the Letter Agreement dated August 28, to read, "C&G agrees to dedicate <br />an ~ foot wide tract of right-of-way. .", and under the paragraph <br />that begins, "The City agrees" to add a new 1 to read as follows and <br />renumber the remaining terms, "1. To cooperate with C & G in determining <br />the exact location for the Right-of-Way," and Ms. Tatum seconded the <br />motion, which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration Item 31 removed from the consent <br />agenda, adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION <br />APPROVING AN <br />INC. FOR THE <br />CITY MANAGER <br />DECLARING AN <br /> <br />OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AGREEMENT BETWEEN THE CITY AND ALAN PLUMMER ASSOCIATES, <br />PROVISION OF AN ODOR ABATEMENT STUDY; AUTHORIZING THE <br />TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY; AND <br />EFFECTIVE DATE. <br /> <br />Ms. Hughson moved for adoption of the Resolution and Ms. Tatum seconded <br />the motion. Ms. Hughson asked how this matter could be expedited, and Mr. <br />Gilley stated Staff is prepared to move quickly. Betty Jordon of Alan <br />Plummer Associates stated they would assess this matter tomorrow. Mr. <br />Mayhew stated it would be helpful to contact the neighborhood <br />representatives and let them know what is planned. Laurie Anderson stated <br />Staff already plans to set up a public meeting on September 12 to advise <br />the neighborhood. Mr. Mihalkanin stated the odor problem was not <br />anticipated and wanted to know if the City could seek any reimbursement <br />from the contractor. Mr. Gilley stated he did not think there was any <br />legal recourse. Council asked staff to pursue this matter. Mr. Taylor <br />stated he would have to review the matter to give an opinion. The Council <br />stated they want that option to be pursued. The Council voted unanimously <br />for adoption of the Resolution. <br /> <br />Mayor Chiu introduced a discussion regarding setting Regular Meeting dates <br />for September, November and December. It was consensus of the Council to <br />set the second Regular Meeting in September for Monday, September 17, <br />hold an Annexation Public Hearing on September 24 (Special Meeting), and <br />set the first Regular Meeting in November for Monday, November 19. The <br />date for second Regular Meeting in December will be discussed at the next <br />meeting. The Council also requested the Council Visioning Workshop be <br />scheduled for January and the Policy Statement Workshop be scheduled in <br />February. These dates will be on the next Council agenda for <br />consideration. <br />
