181. Regular Meeting August 27, 2001 Page 12 AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENTS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. Mr. Mayhew moved for adoption of the Resolution and to amend Page 1 of the Earnest Money Contract under Item 1 to provide a more complete property description, Page 6, Item 12 to complete the blanks of Seller as Danny Gribbon, Facsimile: c/o Gene Majors, 396-8539, and in the second paragraph of the Letter Agreement dated August 28, to read, "C&G agrees to dedicate an ~ foot wide tract of right-of-way. .", and under the paragraph that begins, "The City agrees" to add a new 1 to read as follows and renumber the remaining terms, "1. To cooperate with C & G in determining the exact location for the Right-of-Way," and Ms. Tatum seconded the motion, which passed unanimously. Mayor Chiu introduced for consideration Item 31 removed from the consent agenda, adoption of a Resolution, the caption which was read as follows: A RESOLUTION APPROVING AN INC. FOR THE CITY MANAGER DECLARING AN OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AGREEMENT BETWEEN THE CITY AND ALAN PLUMMER ASSOCIATES, PROVISION OF AN ODOR ABATEMENT STUDY; AUTHORIZING THE TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY; AND EFFECTIVE DATE. Ms. Hughson moved for adoption of the Resolution and Ms. Tatum seconded the motion. Ms. Hughson asked how this matter could be expedited, and Mr. Gilley stated Staff is prepared to move quickly. Betty Jordon of Alan Plummer Associates stated they would assess this matter tomorrow. Mr. Mayhew stated it would be helpful to contact the neighborhood representatives and let them know what is planned. Laurie Anderson stated Staff already plans to set up a public meeting on September 12 to advise the neighborhood. Mr. Mihalkanin stated the odor problem was not anticipated and wanted to know if the City could seek any reimbursement from the contractor. Mr. Gilley stated he did not think there was any legal recourse. Council asked staff to pursue this matter. Mr. Taylor stated he would have to review the matter to give an opinion. The Council stated they want that option to be pursued. The Council voted unanimously for adoption of the Resolution. Mayor Chiu introduced a discussion regarding setting Regular Meeting dates for September, November and December. It was consensus of the Council to set the second Regular Meeting in September for Monday, September 17, hold an Annexation Public Hearing on September 24 (Special Meeting), and set the first Regular Meeting in November for Monday, November 19. The date for second Regular Meeting in December will be discussed at the next meeting. The Council also requested the Council Visioning Workshop be scheduled for January and the Policy Statement Workshop be scheduled in February. These dates will be on the next Council agenda for consideration.
