<br />Regular Meeting <br /> <br />August 27, 2001 <br /> <br />172. <br />Page 3 <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />Bill Haney stated he owns a business on the adjoining property and thinks <br />the property should remain commercial. Jaye Ruffino spoke with Mr. <br />Russell, the owner of the property, regarding apartments or a self-storage <br />building. She stated she is opposed to R-1 zoning at this location, <br />because it will result in at least four students with four cars. She does <br />not think the area can handle this. She stated the property is not <br />suitable for R-1 next to Mr. Haney's business. Terry Whiteman stated she <br />is opposed to single-family zoning of this property. She stated the <br />neighborhood is not safe for children's play with all the traffic in the <br />area. Torn Roach stated he resides at 1301 Clyde, one-half block from this <br />property. He stated he wants the zoning to remain commercial. He stated <br />there is a traffic problem in this area, and if the zoning is changed to <br />single-family, it will be hard to control how many reside there. Russell <br />Smith stated at the Planning and Zoning Commission meeting, no one spoke. <br />He stated there are homes across the street from this property, and there <br />is one lot between this property and Mr. Haney's industrial company. He <br />plans to build a three bedroom/two bath horne, and the Planning and Zoning <br />Commission agreed this would be a good use. He thinks more commercial <br />zoning in this area would be a detriment. No one else wished to speak, so <br />Mayor Chiu closed the public hearing. Mr. Cox moved for adoption of the <br />Zoning Ordinance and Ms. Tatum seconded the motion. Mr. Cox asked Mr. <br />Russell about homes he has built in that area. Mr. Russell stated he has <br />already built five homes in the area. He has built four homes on Marlton, <br />three of which are owner occupied and one is a rental property. A fifth <br />home was built on Knox and is owner occupied. Mr. Cox stated he is <br />sympathetic to the concerns expressed by the neighbors. Mr. Cox noted <br />there are plans for a Code Compliance Officer in the new budget year. <br />R-1 zoning, as is requested in this case, no more than two unrelated <br />persons can reside in a single-family residence. Such situations can be <br />investigated by the Code Compliance Officer. This has been a prevalent <br />practice throughout the community. With a Code Compliance Officer, there <br />will be a remedy. Mr. Cox stated as to speeding vehicles and cars parked <br />in yards, these would be matters to be addressed by the Police Department. <br />Mr. Cox stated most homeowners prefer R-1 to C, and the City is taking <br />steps to increase the City's ability to remedy those situations. Ms. <br />Hughson asked staff to address some of the concerns of the Westover <br />neighborhood regarding police patrol on Thursdays, Fridays and Saturdays. <br />Chief Griffith stated the City is divided into four districts, and double <br />shifts are on patrol during peak periods. He stated Sunday-Wednesday one <br />staff person is assigned to each of four districts. From 9:00 p.m.-3:00 <br />a.m. on Fridays and Saturdays there is an overlap of shifts. Ms. Tatum <br />asked when the Code Compliance Officer would be in place. Ms. Huffman <br />stated a job description would be prepared as soon as the budget is <br />approved, and the person could be on duty by January or sooner. Mr. Cox <br />stated it was his understanding Staff was to look at extending the <br />limitations in R-1 zoning to also apply in DP-2 zoning. Mr. Patterson <br />stated Staff has identified issues to create another duplex district for <br />single-family. This will be one of the top items to discuss when the <br /> <br />In <br />
