This <br />would be considered spot zoning. The Staff would consider the precedent <br />to be a land use issue. Ms. Tatum stated she understood Mrs. Williams <br />could not replace her present home with a similar home. Ms. Tatum stated <br />San Marcos has a lack of affordable housing and she wants Mrs. Williams to <br />be able to place a manufactured home on her property. Mr. Mayhew stated <br />he would support looking at this new zoning designation and having the <br />Task Force look at this issue. Mr. Cox stated he would support looking at <br />the zoning designation. Mr. Cox asked Mr. Patterson if it was better to <br />look at a land use change for a segment of that area, and was the Sector <br />Plan already adopted for this area. Mr. Patterson stated yes. In Low <br />Density Residential, there can be no more than six units per acre. Mr. <br />Patterson stated from a land use standpoint, it would be okay, but the <br />difficulty is whether or not the zoning is appropriate. Mr. Cox stated <br />this zoning would not violate the land use in the Sector Plan. Mr. <br />Patterson stated a precedent to zoning is the issue. Mr. Patterson stated <br />the City could not prohibit someone from replacing a pre-existing 1976 <br />mobile home with a manufactured home, and there tends to be many owner- <br />occupied mobile homes, more as a permanent fixture. Ms. Hughson stated <br />she would prefer to look at a specific use permit process rather than a <br />zoning change. Mrs. Mary Ann Williams stated she is struggling to get a <br />pre-fabricated home on her 502 Centre property and is struggling to <br />survive to see what the City Council will do. She stated she needs the <br />Council's help, and that her home is not a mobile home, as the wheels will <br />be removed and it will be skirted. She stated she has to remove the <br />existing house and is asking to get her lot rezoned. Mayor Chiu stated <br />the Council direction is for Staff to look into a zoning classification <br />and specific use permit process. Mr. Cox asked if Habitat for Humanity <br />could enter into this matter, and Mr. Gilley stated he could check if <br />there was direction to contact Habitat. There was no consensus to do so <br />due to the time that would be required. Ms. Hughson inquired how quickly <br />a specific use permit process could be considered by the Planning and <br />Zoning Commission and get back on the Council's agenda and then estimated <br />the matter could possibly come before the Council by the second meeting in <br />January. Ms. Tatum stated until the Council provides affordable housing, <br />the reality is mobile homes provide this need. She asked the Council if <br />this could be approved and the Council then look at new Ordinance <br />provisions. She stated there is the human element to be considered, and <br />this manufactured home would be as nice as many homes in the neighborhood. <br />Mr. Gilley stated the City Attorney has stated this would be establishing <br />a precedent, and doing this as a temporary measure would not alter the <br />point of setting a precedent. Mr. Cox stated this would be practicing <br />spot zoning, and he would rather follow up on Ms. Hughson's suggestion of <br />establishing a specific use permit process. Mr. Taylor stated it would <br />not be illegal to approve this zoning, but the Council would need to allow <br />other neighbors wanting MR zoning to also be granted the zoning <br />designation. Mr. Cox stated he wants a specific use permit process to be <br />established. Mr. Patterson stated the City Council could override the <br />Planning and Zoning Commission's decision, and the Task Force could look <br />
