<br />178. <br /> <br />Regular Meeting <br /> <br />December 10, 2001 <br /> <br />Page 4 <br /> <br />at a permanent solution. He stated a specific use permit process will <br />impact city-wide, and approval of this zoning would be a precedent for <br />this area. Ms. Hughson stated there will need to be further discussion to <br />seek a resolution of this matter. On roll call the following vote was <br />recorded: <br /> <br />AYE: Mihalkanin, <br />NAY: Mayhew. <br />ABSTAIN: None. <br />The zoning was adopted <br /> <br />Montoya, Hughson, Chiu, Cox, Tatum. <br /> <br />(see reconsideration in Minutes December 17, 2001). <br /> <br />Mayor Chiu introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING ARTICLE 4, WRECKERS, OF CHAPTER 90, VEHICLES FOR HIRE, OF <br />THE SAN MARCOS CITY CODE TO UPDATE, EXPAND AND CLARIFY CITY <br />REGULATIONS FOR WRECKER SERVICES THAT PERFORM TOWS IN THE CITY; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />Bobby New of Doherty's Wrecker Service, referenced Page 7, Section <br />90.244(g) and stated wrecker companies cannot tell insurance companies <br />what to do or how quickly. Mr. New stated concern of the provision on <br />Page 10, Section 90.252(b) wherein if an insurance company does not pay <br />within fifteen days, the wrecker company could be removed from the <br />rotation. Mike Saucedo of Southwest Towing stated he was not aware of the <br />Ordinance revisions until today and asked the Council to table <br />consideration until he can look at the Ordinance. Ms. Hughson stated the <br />Ordinance would be read three times, and he should bring his comments to <br />the Council at the next meeting. Kyle Maysel of the Downtown Parking <br />Committee stated they held public hearings and public meetings, and no <br />formal agreement was made between the committee and with the wrecker <br />companies. The wrecker companies were asked to provide input so that the <br />recommendations would not be overly burdensome on the wrecker companies. <br />Many people participated in the meetings, but no promises were made what <br />would be recommended. Mr. Maysel stated the wrecker companies did not <br />participate in the meetings, although invited to do so. No one else <br />wished to speak, so Mayor Chiu closed the public hearing. Mr. Mayhew <br />moved for approval of the Ordinance on first reading and Mr. Montoya <br />seconded the motion. Ms. Hughson asked why the Ordinance is requiring two <br />wreckers, including one flatbed. Sgt. Jeff Caldwell stated it was a <br />suggestion from the wrecker companies, and the Police Department also <br />thought it would help with the time frames of the wreckers on the rotation <br />list. Ms. Hughson stated in order to be eligible for the list of Central <br />Texas System Registration, a company cannot be delinquent in taxes.
