Ms. Tatum stated it might be hard to find someone who qualifies who <br />does not apply for funding, so maybe we could consider letting them abstain from the <br />funding issues. Mr. Cox stated Ms. Brown had the same concerns and she only knew of <br />one organization which received only State funding and not city funding. Ms. Hughson <br />asked if this could be taken back to the Ethics Committee. Mr. Taylor stated yes this <br />could be taken to the Ethics Committee at their January meeting. <br /> <br />Mayor Chiu introduced for consideration approval of one appointment to the Central <br />Texas Higher Education Authority Board. Mr. Cox moved to appoint Dr. Betty Starling, <br />which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration approval of an Ordinance on first reading, the <br />caption which read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS DEDICATING VARIOUS TRACTS OF REAL PROPERTY <br />IN THE CITY FOR PARK PURPOSES; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading and Mr. Mayhew <br />seconded the motion. Ms. Hughson asked if these were zoned "P". Mr. Gilley stated <br />they would be making all zoned "P". The Council voted unanimously for approval of the <br />Ordinance on first reading. <br /> <br />Mayor Chiu introduced for consideration approval of an Ordinance on first reading, the <br />caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING DIVISION 3 OF ARTICLE 3 OF CHAPTER <br />34, ENVIRONMENT, OF THE SAN MARCOS CITY CODE TO ADD <br />REGULATIONS PERTAINING TO NOISE FROM VEHICLES AND FROM <br />PARTIES IN RESIDENTIAL AREAS; INCLUDING PROCEDURAL <br />PROVISIONS; PROVIDING FOR PENALTIES; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading and Ms. Hughson <br />seconded the motion. Ms. Hughson asked if the definitions were consistent with the <br />"Parties" Ordinance, Ms. Sherri Russell, Assistant City Attorney stated the definition of <br />"residents" is the only definition that is different. Ms. Hughson stated the definitions <br />need to be the same in both Ordinances. She also asked how the amount of 30 feet or <br />more was arrived on the noise from a vehicle and expressed concern that the number <br />should be lower. Ms. Russell stated the 30 feet is a reasonable standard. Chief Griffith <br />stated the 30 feet was taken from the City of Austin's Ordinance, which has been tested. <br />Ms. Hughson stated she wanted the word required added to Section 34.092 (b) normal <br />course of business.. .. Ms. Hughson asked how we would notify the occupants of the <br />residence their electric services will be suspended, since the reason we are considering <br />this step is because no one will answer the door.
