<br />213. <br />Regular Meeling <br /> <br />December 17, 200 1 <br /> <br />Page 6 <br /> <br />AYE: Mihalkanin, Montoya, Chiu, Tatum. <br /> <br />NAY: Hughson, Cox, Mayhew. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />The motion failed. <br /> <br />Mayor Chiu introduced for consideration approval of an Ordinance on second reading, <br />the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, AMENDING ARTICLE 4, WRECKERS, OF CHAPTER 90, <br />VEHICLES FOR HIRE, OF THE SAN MARCOS CITY CODE TO UPDATE, <br />EXP AND AND CLARIFY CITY REGULATIONS FOR WRECKER <br />SERVICES THAT PERFORM TOWS IN THE CITY; INCLUDING <br />PROCEDURAL PROVISIONS AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Hughson moved for approval of the Ordinance on second reading and Mr. Mayhew <br />seconded the motion. Ms. Hughson stated the proposed Ordinance says the signs have to <br />be plainly lit.. Does this mean that the sign must have it's own lighting, or just that it's <br />visible under an existing street light? Mr. Taylor stated it was the Downtown Parking <br />Advisory Committee's intent to make it visible from at least 100 feet with some light. <br />Ms. Hughson asked if a complaint pertaining to damages by police-authorized tow, must <br />be paid or a claim filed with the insurance company within 15 days or the service will <br />automatically be suspended from the rotation until payment is made, is this only when it <br />was not taken care of. She noted that the change requested at the last meeting, now <br />leaves it undetermined as to if the claim is paid since we will not be notified. Chief <br />Griffith stated the company is suspended only if the claim has not been paid, Mr. <br />Mayhew asked if the City kept up with the payments from the insurance companies. Mr. <br />Mihalkanin stated keeping up with the insurance payments would really take more time <br />and paperwork for the City staff. Mr. Saucedo stated on the bottom of his tickets there is <br />a 1-800 number and procedures on how to handle this type of situation. Ms. Hughson <br />stated the original intent was to pull the wrecker services off rotation if they are <br />damaging cars. Mr. Mayhew asked for this part of the Ordinance to be made stronger. <br />Mr. Mihalkanin asked before the next reading if he could have the language from the old <br />Ordinance. Ms. Hughson stated she wanted the Chief to be notified when the payment is <br />made to the car owners and to add into the proposed Ordinance a time frame for the <br />insurance companies to pay. Mr. Saucedo stated it takes his insurance 30 days to pay, <br />Mr. Mihalkanin directed the staff to contact some local insurance companies to get a time <br />frame for when insurance companies pay claims. Ms. Hughson stated when a wrecker <br />service is called to tow and the vehicle owner shows up while their car is being hooked <br />up, the wrecker service should be compensated and twenty dollars seems to be fair. Ms. <br />Hughson stated she has concerns about the 25-minute time limit it takes to arrive to a <br />call. Chief Griffith stated the Ordinance now allows 20-minutes and we have not had to <br />
