The <br />Council voted unanimously for approval of the Ordinance on first reading. <br /> <br />Mayor Chiu introduced for consideration adoption of an Ordinance on third and final <br />reading, the caption was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 114.578 OF THE ZONING <br />CHAPTER OF THE CITY CODE TO REVISE REGULATIONS PERTAINING <br />TO ALCOHOLIC BEVERAGE SPECIFIC USE PERMITS IN THE CENTRAL <br />BUSINESS AREA ZONING DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Ms. Hughson made a motion for adoption of the Zoning Ordinance on third and final <br />reading and Mr. Mayhew seconded the motion. Ms. Hughson moved to amend the <br />Ordinance such that the number of restricted permits to be lowered from 15 to 12, Mr. <br />Mihalkanin seconded the motion, whichpassed unanimously.. The Council then voted <br />unanimously for the adoption of the Zoning Ordinance on third and final reading. <br /> <br />Mayor Chiu introduced an Executive Session pursuant to the Government Code, Section <br />551.071 , to seek the City Attorney's advice regarding pending litigation, contemplated <br />litigation or other matters (Weatherford vs. City of San Marcos; Southwest San Marcos <br />Annexation); and Section 551.074, to discuss the duties of a public officer (City Clerk- <br />voting precincts). Mr. Milhalkanin moved to adjourn into Executive Session at 9:40 p.m. <br />and Mr. Mayhew seconded the motion, which passed unanimously. <br /> <br />Ms. Hughson moved to reconvene at 11 :05 p.m. and Ms. Tatum seconded the motion, <br />which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration approval of three Ordinances on second <br />reading; adoption of two Ordinances on third and final reading, adoption of nine <br />Resolutions and approval of one Change Order No.4 to the Hunter Road Fire Station in <br />the amount of $25,296.32 on consensus. The City Council removed Items 17, 18, 19, and <br />24, adoption of Resolutions, to be considered separately. Mr. Mayhew moved for <br />approval of the three Ordinances on second reading, adoption of the two Ordinances on <br />the third and final reading, and adoption of the remaining five Resolutions and Change <br />Order No.4 to the Hunter Road Fire Station in the amount of $25,296.32 on consensus, <br />and Mr. Montoya seconded the motion, which passed unanimously.
