No Federal appropriated funds have been paid or will be paid, by or on behalf of it, to any person <br />for influencing or attempting to influence an officer or employee of any agency, a Member of <br />Congress., an officer or employee of Congress, or an employee of a Member of Congress in. <br />connection with the awarding of any Federal contract, the inakuiig of any Federal grant. the making <br />of any Federal loan, the entering into of any cooperative agreement, and the extension, continuation., <br />renewal, amendment or modification of any Federal contract, ant, loan, oi- cooperative <br />l I I gr <br />agreement., <br />(ii.) Lobbyinfa Certification <br />This certification is a material representation of fact upon which reliance was placed when this <br />transaction was made or entered into. Submission of this certification is a prerequisite for making <br />or enterbig into d-iis transaction imposed by section 1352, We 3 1., U.S.C. Any person who fails to <br />file the required certification shall be subject to a civil penalty of not less than $101000 and not more <br />than $100,000 for eac h suc h fa ilure. <br />h. LEAD-BASED PAINT <br />The Contractor agrees that any construction or rehabilitation of residential structures with assistance <br />provided under this Agreement shall be subject to HUD Lead- Based Paint Regulations at24 CPR 570.608, <br />and. 24 CPR Part 35, Subpart B. Such regulations pertain to all CDBG-DR-assisted housing and require, <br />that all owners, prospective owners, and tenants of properties constructed prior to 1978 be properly <br />notified that such properties may include lead-based paint. Such notification shall point out the hazards <br />of lead-based. paint and explain the symptoms. treatment and precaLltiOIIS that should be taken when <br />dealing with lead-based paint poisoning and the advisability and availability of blood lead level screening <br />for children under seven. The notice should also point out that if lead- based paint is found on the property, <br />abatement measures may be undertaken. The regulations further require that, depending on the amount of <br />Federal funds applied to a prope Ity.., paint testing, risk assessment, treatment and/or abatement may be <br />conducted, <br />i. ELOOD DISASTER PROTECTION <br />I <br />In accordance with the requirements of the Flood Disaster Protection Act of 1973 (42 U.
