<br />96. <br />Regular Meeting <br /> <br />March 26, 2001 <br /> <br />Page 4 <br /> <br />adoption of the Zoning Ordinance and Mr. Mayhew seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 3, BLOCK <br />1, SAN MARCOS BUSINESS PARK, LOCATED AT 1917 DUTTON DRIVE, FROM "LIH <br />(LIGHT INDUSTRIAL DISTRICT) TO "CH (COMMERCIAL DISTRICT); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Chiu closed the public hearing. Mr. Mayhew moved for <br />adoption of the Zoning Ordinance and Mr. Doiron seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Chiu introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />READOPTING CHAPTER 18, ARTICLE 6 OF THE CITY CODE ENTITLED SEXUALLY <br />ORIENTED BUSINESSES WITH AMENDMENTS AFTER PUBLIC HEARING AND REVIEW <br />OF STUDIES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mr. Taylor asked Chief Griffith if he had reviewed the 32 land use <br />studies, and he responded yes. Mr. Taylor asked Chief Griffith if <br />sexually oriented businesses impact crime in the vicinity of the business, <br />and Chief Griffith stated where sexually oriented businesses are located, <br />there is increased crime. Mr. Taylor asked Mr. Patterson if he had <br />reviewed the 32 land use studies, and Mr. Patterson stated yes. Mr. <br />Taylor asked if there is a detrimental impact on property values in the <br />vicinity of sexually oriented businesses, and Mr. Patterson stated yes. <br />The Council was advised a sexually oriented business cannot be located <br />within 1000 feet of a public park, church, school, residential district, <br />bar, residential use or other sexually oriented business and the total <br />land area designated for the location of a sexually oriented business is <br />3% and all such properties are zoned Commercial. Mr. Taylor asked Mr. <br />Patterson if Commercial zoning was a viable designation for a sexually <br />oriented business, and Mr. Patterson stated yes. Mayor Chiu opened the <br />public hearing and asked if anyone wished to speak. No one wished to <br />speak, so Mayor Chiu closed the public hearing. Mr. Moseley moved for <br />approval of the Ordinance on first reading and Mr. Doiron seconded the <br />motion. Mr. Moseley moved to amend Sec. 18.242(a) (5) to complete the <br />blank with 385.84 acres and Mr. Doiron seconded the motion, which passed <br />unanimously. Mr. Moseley asked if Staff anticipated growth in this type <br />business, and Mr. Taylor stated we have occasional inquiries. The Council <br />then voted unanimously for approval of the Ordinance on first reading. <br />
