any, the City shall have the option to terminate this agreement subject to the mutual requirements <br />of 3 (A). <br />E. Employee's Death. Employee's employment shall terminate on the date of his death, in <br />which event the salary and benefits owing to Employee, except life insurance, through the date <br />of death shall be paid to Employee's beneficiary. Life insurance proceeds shall be paid by the <br />insurer to the beneficiary(ies) designated by Employee. <br />Section 4: Best Efforts <br />A. Employee agrees to devote his best efforts, energies, and skill to the discharge of the duties <br />and responsibilities attributable to his position, and to this end, he will devote his full time and <br />attention exclusively to the business and affairs of the City during the normal working hours of <br />the City, and outside of such hours to the extent needed to fulfill his duties and responsibilities. <br />The Employee understands and agrees that he is subject to all generally applicable policies of the <br />City. The generally applicable policies of the City include, but are not limited to, employment <br />policies, financial and purchasing policies, and ethics regulations. Employee agrees that he may <br />not derive any personal advantage or gain, either directly or indirectly, with respect to any <br />business transaction in which the City engages, and that he will promptly disclose in writing to <br />the City Council all facts that are material to any such potential profit or gain. <br />B. The Employee shall be responsible for the judicial functions of the Municipal Court and shall <br />supervise, control, and direct the operation and clerical functions of the administrative <br />department of the court including the court administrator, clerks, and other court personnel. <br />C. The Employee agrees to comply with applicable provisions of law related to his judicial <br />functions, including without limitation, Chapter 45 of the Texas Code of Criminal Procedure, <br />and the Texas Code of Judicial Conduct. <br />D. The Employee understands and agrees that under Section 55.05 of the San Marcos City Code <br />the city manager or his designee appoints the clerk of the municipal court, to be known as the <br />court administrator, and such other municipal court clerks as the city manager may deem <br />appropriate. The Employee understands that Municipal Court Clerk shall perform all duties of a <br />court clerk as provided under state law, the city charter, Chapter 55 of the San Marcos City <br />Code, and shall also perform the following: <br />(1) Establishing and revising procedures related to the administration of the Municipal <br />Court, including procedures for the collection of fines, fees, costs and bonds; <br />(2) Scheduling trial dockets and, if necessary, arraignment dockets, on days and times <br />and with sufficient frequency to ensure the prompt disposition of cases before the court; <br />(3) Preparing and submitting a report each month to the City Manager and the Employee <br />showing the style, number and disposition of each case disposed of in the court during the <br />preceding month, and also showing the amount of fine assessed in each case, and how the fine <br />was satisfied, whether by payment, by community service, or by other means; <br />(4) Formulating proposed budgets for the Municipal Court with input from the Employee; <br />Page 3 of 7 <br />
