<br />230 <br /> <br />Regular Meeting <br /> <br />May 21, 2001 <br /> <br />Page 3 <br /> <br />Zoning Ordinance and Mr. Mihalkanin seconded the motion. <br />following vote was recorded: <br /> <br />On roll call the <br /> <br />AYE: <br /> <br />Mihalkanin, Moseley, Chiu, Cox, Mayhew. <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: <br /> <br />Hughson (affidavit). <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 9.03 ACRE <br />TRACT OF PROPERTY LOCATED AT 1414 PROSPECT STREET, FROM "Z1" (ZERO <br />LOT LINE DISTRICT) AND "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW <br />DENSITY]) TO "pH (PUBLIC AND INSTITUTIONAL DISTRICT); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Cox filed a disclosure affidavit with the City Clerk and left the <br />Council Chambers during consideration of this Ordinance. Mayor Chiu <br />opened the public hearing and asked if anyone wished to speak. Noone <br />did, so Mayor Chiu closed the public hearing. The Council <br />removed Item 11, approval of an Ordinance on second reading, Item 19, <br />adoption of an Ordinance on third and final reading, and Item 24.5, remove <br />from table and adoption of a Resolution, to be considered separately. Mr. <br />Moseley moved for approval of the remaining four Ordinances on second <br />reading, adoption of the remaining seven Ordinances on third and final <br />reading, adoption of three Resolutions, approval of Change in Services No. <br />4 regarding the Posey Road Water Line Project, and approval of Change <br />Order No.3 regarding the Victory Gardens and East Guadalupe Sanitary <br />Sewer Rehabilitation Project on consensus and Mr. Mayhew seconded the <br />motion, which passed unanimously (Mr. Mihalkanin and Ms. Hughson <br />
