No study has been done on the impact of this <br />development. Mr. Maysel stated SWT students own cars. He stated the <br />streets in this area could not handle the traffic this development would <br />create. He stated ZBOA granted variances without any statistics being <br />presented. He requested the Council take a close look at this <br />development, because it could create a horrible situation. Mr. Mihalkanin <br />stated this development could potentially cause problems downtown and <br />thinks the Council should table this matter and get more information from <br />the developer. Mr. Cox asked if Staff could address any of the issues <br />raised. Ms. Hughson asked if the City Council could do anything regarding <br />a variance ZBOA has granted. Mr. Cox stated he wants to have specific <br />answers to the size of the development. Mr. Patterson stated ZBOA <br />considered a proposed mixed use in a one-half block area in the vicinity <br />of El Arroyo and Rother's Bookstore. The developer advised ZBOA they <br />wanted to build to the lot line and would put in landscaping, and this <br />passed unanimously. The developer also requested a parking variance to <br />allow one parking space for each resident on a lease. Later the same <br />evening the Planning and Zoning Commission considered a mix of uses, <br />residential in a commercial district. Mr. Mihalkanin asked how the <br />property designation was presented to ZBOA and P&Z. It was agendized as <br />the 300 Block of LBJ. Mr. Cox stated he was contacted by the Downtown <br />Parking Committee, and stated the Planning and Zoning Commission issues <br />specific use permits (SUPs) without such matters coming to the Council. <br />Ms. Hughson asked if this could be changed when the Subdivision Ordinance <br />is updated. Mr. Cox stated is the issue before the Council a determinent <br />to move forward with this project. Mr. Patterson stated the electric <br />easements go through the property and would impact the development. Mr. <br />Mihalkanin moved to table this matter to the first substantive meeting in <br />June and requested the developer and staff present additional information <br />and Mr. Mayhew seconded the motion. On roll call the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Hughson, Cox, Mayhew. <br /> <br />NAY: <br /> <br />Moseley, Chiu. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />Mayor Chiu introduced for consideration Item 24.5 removed from the consent <br />agenda, remove from table and adoption of a Resolution, the caption which <br />was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF A LICENSE AGREEMENT FOR <br />ATTACHMENTS TO UTILITY FACILITIES BETWEEN THE CITY AND FIBER AMERICA <br />NO.1, L.P.; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON <br />BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br />
