<br />217. <br /> <br />Regular Meeting <br /> <br />September 10, 2001 <br /> <br />Page 4 <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Chiu closed the public hearing. Mr. Mihalkanin moved <br />for approval of the Ordinance on first reading and Ms. Tatum seconded the <br />motion, which passed unanimously. <br /> <br />Mayor Chiu introduced a public hearing regarding a request for a permanent <br />specific use permit for Don Lalo's Mexican Restaurant at 400 Cheatham <br />Street. Mayor Chiu opened the public hearing and asked if anyone wished <br />to speak. Lillian Garcia stated she was against this specific use permit <br />being granted. She stated the incident she discussed earlier in the <br />meeting was one of the reasons her family was opposed. The owners of the <br />restaurant had stated they wanted to meet with the neighbors and have not <br />done so. Elvin Holt stated he lives at 329 E. Grove around the corner <br />from the Garcias. He stated he has not personally experienced incidents <br />but is in support of the Garcias, so he is opposed to the granting of this <br />permit. Brad Gulick stated he is in favor of this permit being granted. <br />Mr. Gulick stated the Lalo's Restaurant relocated in San Marcos from <br />Midland. He stated parking at their business has not been a problem and <br />offered his facility, The Meeting Place, if a meeting place is needed to <br />work out any problems. Richard Padilla of Lalo's Mexican Restaurant <br />stated they have asked the Garcia family to call them if they have any <br />problems. They love being in San Marcos and do not think their business <br />will survive without the specific use permit. Mr. Padilla stated he <br />thought it would be unfair to not allow them to be granted the specific <br />use permit because of one incident. Anna Mendoza stated she is a neighbor <br />of the Garcias. She stated everything has been fine for the present time. <br />She fears if the problem gets worse though, it will be too late to remedy <br />the problem. She stated departments will not help them in the future. <br />She stated if the problem is eliminated now, there will not be a problem <br />in the future. Lillian Garcia stated it is unfortunate they experienced <br />the recent incident. She stated students are now becoming more aware that <br />Lalo's Restaurant serves alcohol and will go there. She stated they are <br />taxpayers, and this is their home. If someone needs to leave, she thinks <br />it needs to be the business. No one else wished to speak, so Mayor Chiu <br />closed the public hearing. Mr. Taylor advised the Council this matter <br />will be scheduled on a future Council agenda for consideration after <br />public notice in the newspaper. He determined it would probably corne to <br />the Council on October 8. <br /> <br />Mayor Chiu introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />SETTING THE TAX RATE FOR THE 2001 TAX YEAR; LEVYING TAXES FOR THE USE <br />AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY FOR THE FISCAL <br />YEAR BEGINNNING OCTOBER 1, 2001, AND ENDING SEPTEMBER 30, 2002; <br />PROVIDING A SINKING FUND FOR THE RETIREMENT OF THE BONDED DEBT OF THE <br />CITY; AND DECLARING AN EMERGENCY. <br />
