RESOLUTION NO.2019-11OR <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A THREE-YEAR EXTENSION OF A <br />PROPERTY USE AGREEMENT BETWEEN THE CITY AND TEXAS <br />STATE UNIVERSITY FOR THE CITY'S USE OF A PARKING AREA <br />DOWNTOWN AND TEXAS STATE UNIVERSITY'S USE OF A <br />PARKING AREA ALONG CHARLES AUSTIN DRIVE; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF <br />OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. By Resolution No. 2003-43R, the City Council approved a Property Use <br />Agreement with Southwest Texas State University, now known as Texas State University, (the <br />"Agreement") under which the City authorized Texas State University to use designated parking <br />areas along Charles Austin Drive and Texas State University authorized the City to use <br />designated parking areas behind Fire Station Number One downtown. <br />2. The Agreement was amended and restated on August 2, 2016, and extended <br />through July 31, 2019. <br />3. The parties wish to renew and extend the Agreement for an additional three-year <br />term effective August 1, 2019. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached Renewal and Extension of Parking Use Agreement between <br />the City and Texas State University is approved. <br />PART 2. The City Manager is authorized to execute the Renewal and Extension of <br />Parking Use Agreement on behalf of the City. <br />PART 3.
