Ms. Hughson <br />asked what is the project completion time, and Ms. Anderson stated <br />December this year or if any conflicts, it might go into January. Ms. <br />Anderson stated the LBJ/Holland intersection will be the first thing they <br />address. There will be additional time with change orders, and the City <br />will receive liquidated damages when the contractor exceeds the time <br />frames. Mr. Mihalkanin stated he thinks the signs are the biggest <br />complaint regarding the project. (2) Ms. Hughson reminded Staff to <br />agendize the Pledge of Allegiance. (3) Ms. Hughson stated the Council <br />needs to reconsider Item 23 on this agenda due to amendments requested by <br />staff that were not addressed during passage of the consent agenda. (4) <br />Ms. Hughson stated the appointee evaluations need to be scheduled, <br />possibly in November when a full meeting is not planned. <br /> <br />Mayor Chiu introduced for consideration reconsideration of Item 23, <br />adoption of an Ordinance on third and final reading, the caption which <br />reads as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />REVISING AND UPDATING ARTICLE 6, EDWARDS AQUIFER PROTECTION <br />REGULATIONS, OF CHAPTER 94, DEVELOPMENT STANDARDS, OF THE CITY CODE; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Hughson moved to reconsider the Ordinance and Mr. Mayhew seconded the <br />motion, which passed unanimously (Mayor Chiu not present to vote on this <br />matter). Mr. Mayhew withdrew his motion for adoption of the Ordinance on <br />third and final reading and Ms. Tatum withdrew her second. Mr. Mayhew <br />then moved for adoption of the Ordinance on third and final reading <br />including the amendments provided at this meeting and Ms. Tatum seconded <br />the motion, which passed unanimously (Mayor Chiu not present to vote on <br />this item). <br /> <br />Mayor Pro-Tern Hughson introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to seek the City Attorney's advice <br />regarding pending litigation, contemplated litigation or other matters <br />(Hispanic Chamber of Commerce contracts); Sections 551.072, to discuss the <br />purchase of real property (Downtown area); Section 551.074, to discuss the <br />duties of a public officer (City Manager) (water wells/water supply; bus <br />bench contract); and Section 551.086, to deliberate the offer of a <br />financial or other incentive to a business prospect with which the City is <br />conducting economic development negotiations (Holland Street area). Mr. <br />Mihalkanin moved the Council adjourn into Executive Session at 10:28 p.m. <br />and Mr. Mayhew seconded the motion, which passed unanimously (Mayor Chiu <br />not present to vote on this item). <br /> <br />Ms. Tatum moved to reconvene at 11:45 p.m. and Mr. Mayhew seconded the <br />motion, which passed unanimously. <br />
