Ms. Hughson asked if Lots 1 and 2 had the same owner, and Mr. Patterson stated yes, they were platted together, and the extension of Suncrest Lane has a separate owner and is out of the City limits. Ms. Hughson stated she was concerned about access to Lot 2, and Mr. Patterson stated there is no separate road. The Council voted unanimously for adoption of the Zoning Ordinance. Mayor Chiu introduced for consideration a public hearing and adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A SPECIFIC USE PERMIT FOR THE SALE OF ALCOHOLIC BEVERAGES FOR THE DON LALOS MEXICAN RESTAURANT AT 400 CHEATHAM STREET; AND DECLARING AN EFFECTIVE DATE. Mayor Chiu opened the public hearing and asked if anyone wished to speak. Lillian Garcia stated she is opposed to Lalo's having a liquor license because of past situations and loitering. She stated she does not want this in their neighborhood. No one else wished to speak, so Mayor Chili closed the public hearing. Mr. Mihalkanin moved for adoption of the Resolution and Mr. Mayhew seconded the motion. Ms. Hughson asked Ms. Garcia if the restaurant owners had contacted her since the last meeting, and Ms. Garcia stated they had not. Mr. Montoya stated he was disappointed to learn this small business did not contact the neighborhood. Mr. Cox stated there seems to be a question whether or not they are still in business and if the matter should be tabled to give Staff time to query them. Ms. Garcia stated it appears to be closed and that no one had been there for about a week. On roll call the City Council unanimously denied this Resolution. Mayor Chiu introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTIONS 42.001, 42.076 AND 42.129, AND ADDING AN ARTICLE 5, TAX INCENTIVES, OF CHAPTER 42, HISTORIC PRESERVATION, OF THE CITY CODE TO PROVIDE TAX INCENTIVES FOR THE PRESERVATION OF HISTORIC BUILDINGS; AND INCLUDING PROCEDURAL PROVISIONS. Ms. Hughson moved for approval of the Ordinance on first reading and Ms. Tatum seconded the motion. Ms. Hughson this is quite different than the Ordinance that came before the Council before. She stated now it is just the difference in valuation, and Mr. Hill Rylander, Chair of the Historic Preservation Commission, stated that is correct. Ms. Hughson stated this is for City taxes only, and Mr. Rylander stated yes and thinks this incentive would encourage restoration and improvements with the ten-year tax relief on those improvements. Ms. Hughson queried if the tax relief would also include the increased valuation during those ten years and was advised it would not.
