<br />35. <br /> <br />Regular Meeting <br /> <br />October 8, 2001 <br /> <br />Page 4 <br /> <br />Patterson stated traffic calming had been discussed. Ms. Hughson asked if <br />Lots 1 and 2 had the same owner, and Mr. Patterson stated yes, they were <br />platted together, and the extension of Suncrest Lane has a separate owner <br />and is out of the City limits. Ms. Hughson stated she was concerned about <br />access to Lot 2, and Mr. Patterson stated there is no separate road. The <br />Council voted unanimously for adoption of the Zoning Ordinance. <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING A SPECIFIC USE PERMIT FOR THE SALE OF ALCOHOLIC BEVERAGES <br />FOR THE DON LALOS MEXICAN RESTAURANT AT 400 CHEATHAM STREET; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />Lillian Garcia stated she is opposed to Lalo's having a liquor license <br />because of past situations and loitering. She stated she does not want <br />this in their neighborhood. No one else wished to speak, so Mayor Chili <br />closed the public hearing. Mr. Mihalkanin moved for adoption of the <br />Resolution and Mr. Mayhew seconded the motion. Ms. Hughson asked Ms. <br />Garcia if the restaurant owners had contacted her since the last meeting, <br />and Ms. Garcia stated they had not. Mr. Montoya stated he was <br />disappointed to learn this small business did not contact the <br />neighborhood. Mr. Cox stated there seems to be a question whether or not <br />they are still in business and if the matter should be tabled to give <br />Staff time to query them. Ms. Garcia stated it appears to be closed and <br />that no one had been there for about a week. On roll call the City <br />Council unanimously denied this Resolution. <br /> <br />Mayor Chiu introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTIONS 42.001, 42.076 AND 42.129, AND ADDING AN ARTICLE 5, <br />TAX INCENTIVES, OF CHAPTER 42, HISTORIC PRESERVATION, OF THE CITY <br />CODE TO PROVIDE TAX INCENTIVES FOR THE PRESERVATION OF HISTORIC <br />BUILDINGS; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Ms. Hughson moved for approval of the Ordinance on first reading and Ms. <br />Tatum seconded the motion. Ms. Hughson this is quite different than the <br />Ordinance that came before the Council before. She stated now it is just <br />the difference in valuation, and Mr. Hill Rylander, Chair of the Historic <br />Preservation Commission, stated that is correct. Ms. Hughson stated this <br />is for City taxes only, and Mr. Rylander stated yes and thinks this <br />incentive would encourage restoration and improvements with the ten-year <br />tax relief on those improvements. Ms. Hughson queried if the tax relief <br />would also include the increased valuation during those ten years and was <br />advised it would not.
