<br />34. <br /> <br />Regular Meeting <br /> <br />October 8, 2001 <br /> <br />Page 3 <br /> <br />Mr. Taylor if he had a conflict of interest, and it was determined that he <br />did. Mr. Montoya signed a disclosure affidavit-real property and left the <br />Chambers. No one else wished to speak, so Mayor Chiu closed the public <br />hearing. Mr. Cox moved for approval the Ordinance on first reading and <br />Mr. Mayhew seconded the motion, which passed unanimously (Messrs. <br />Mihalkanin and Montoya and Ms. Hughson abstaining). <br /> <br />Mayor Chiu introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 102.029 OF THE CITY CODE BY ADOPTING THE SECTOR <br />SEVEN PLAN; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALITES. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Chiu closed the public hearing. Mr. Cox moved for <br />approval of the Ordinance on first reading and Mr. Mayhew seconded the <br />motion. Mr. Mihalkanin requested a map be provided that shows the current <br />land use, and Mr. Patterson stated he would provide this at second <br />reading. Mr. Cox asked Staff to provide a brief overview. Mr. John <br />James, Chief Planner, stated the process began in 1999. Two public <br />hearings were held and then the Plan was presented to the Planning and <br />Zoning Commission, who recommended approval to the City Council. The <br />future land use plan is predominently commercial along the frontage, high <br />and medium density behind the commercial, and then neighborhoods. Medium <br />density is recommended for Mill Street with some transportation <br />recommendations included. Ms. Hughson asked what the lavender color <br />designated on the map and was advised that is railroad designation. The <br />Council voted unanimously for approval on first reading. <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 7.43 ACRE <br />TRACT OF PROPERTY LOCATED IN THE 100 BLOCK OF SUNCREST LANE, FROM "R- <br />1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "LB" (LIMITED <br />BUSINESS DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Chiu closed the public hearing. Mr. Cox moved for <br />adoption of the Zoning Ordinance and Ms. Tatum seconded the motion. Mr. <br />Mihalkanin asked where access is to the property, and Mr. Patterson stated <br />Lots 1 and 2 and one commercial lot on Highway 123 with no access allowed <br />on Suncrest. Mr. Patterson stated for the interim access is across Lot 1. <br />Ms. Hughson asked where DeZavala is and Mr. Patterson advised on the <br />opposite side of Highway 123. Ms. Hughson stated there had been some <br />discussion regarding keeping traffic out of the neighborhood, and Mr. <br />
