The Council may wish to look at the specifications <br />if the City wants to receive bids. It was consensus of Council to receive <br />bids. Mr. Gilley stated he would bring the Council formal action to <br />provide notice to BFI. <br /> <br />Mayor Chiu introduced a discussion regarding Arts funding procedures and <br />direction to Staff. Mr. Mayhew stated he saw pictures being taken of the <br />statue on the Square and thinks permanent art is a good expenditure of <br />Arts funding. Mr. Mayhew provided the Council with the guidelines <br />previously used by the Convention and Visitors' Bureau, who had the <br />responsibility of this funding prior to the Arts Commission. Mr. Gilley <br />provided the current guidelines. The Council needs to review these prior <br />to the next meeting. This matter will be agendized again for the December <br />10 meeting. <br /> <br />Mayor Chiu introduced Item 26, a discussion regarding the application of <br />the San Marcos River Corridor Ordinance as a San Marcos Watershed <br />Protection Ordinance and direction to Staff. Ms. Hughson asked Mr. Gilley <br />about EPA's stormwater requirements and when we will be required to <br />comply, and Mr. Gilley stated they are population driven. Ms. Hughson <br />stated it would make sense to incorporate the EPA guidelines at the time <br />we work on this ordinance. Mr. Patterson advised the City should receive <br />the rewrite of the Development Code by April, 2003. Ms. Hughson does not <br />want to wait that long to protect the watershed. Mr. Patterson stated it <br />would be up to the City to come up with the criteria. Mr. Taylor stated <br />Mr. Jack Gary asked when this matter would be coming back before the <br />Council since it relates to his recent request. Mr. Gilley stated Staff <br />could bring some recommendations back to the Council, while we are waiting <br />for the rewrite of the Development Code. Mr. Patterson stated Turner, <br />Collie and Braden are ready to move posthaste. Ms. Hughson stated she <br />thought it should have been done by now, as recommended by the Development <br />Ordinance Review Task Force. Mr. Mihalkanin agreed and added we need to <br />move independently (of the Development Code rewrite) on this item. Mr. <br />Mihalkanin inquired as to the laws regarding fill allowed to be in the <br />dirt dumped in the Purgatory and wanted to know what the sanctions are. <br />Staff will determine and advise him. It was consensus of the Council to <br />proceed with the Watershed Protection item and not wait on the Development <br />Code rewrite. <br /> <br />Mayor Chiu introduced Item 23 which had been tabled earlier in the <br />meeting, the caption which reads as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT BETWEEN THE CITY <br />AND DUNKIN, SEFKO & ASSOCIATES, INC. FOR PREPARING A LAND DEVELOPMENT <br />CODE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF <br />OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />
