Mr. Mihalkanìn then moved to table this <br />matter until later in the meeting and Mr. Mayhew seconded the motion, <br />which passed unanimously (see Page 11). <br /> <br />Mayor Chiu introduced for consideration Item 24 removed from the consent <br />agenda, adoption of a Resolutìon, the captìon which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF A LICENSE AGREEMENT BETWEEN THE <br />CITY AND BURKET TRANSIT ADVERTISING, INC. FOR THE PLACEMENT OF BUS <br />BENCHES AND SHELTERS ON RIGHT-OF-WAY IN THE CITY; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mayhew moved for adoption of the Resolution and Ms. Tatum seconded the <br />motion. Mr. Burkett reviewed the terms of the agreement with the Council. <br />Ms. Hughson asked if the items in 6 (benches) were made of recycled <br />materials, and Mr. Burkett stated yes. Mr. Mihalkanin stated he wants the <br />placement of the benches to be well planned, and Mr. Burkett stated they <br />have planned locations as shown on the map provided. Mr. Gilley stated <br />the old benches would be removed. Mr. Mihalkanin asked how deep the <br />shelters are because when it rains, there needs to be some protection <br />provided. Mr. Burkett stated the shelters are 5 feet deep and 13 feet <br />from side to side and can be enclosed. Mr. Burkett requested an amendment <br />to the agreement. Ms. Hughson moved to amend Section 9 from 50 to 25 <br />benches and Mr. Mihalkanin seconded the motion, which passed unanimously. <br />Mr. Burkett stated he would try to get 50 benches placed by June 1st. <br /> <br />Mayor Chiu introduced a discussion regarding specific use permits and <br />zoning changes and direction to Staff. Ms. Hughson stated since zoning <br />changes come to the Council, she thinks specific use permits which alter <br />what is essentially zoning, should also come to the Council. Mr. <br />Mihalkanin agreed. Mr. Patterson asked if there is a percentage with which <br />the Council would be comfortable. Mr. Mihalkanin stated he would be in <br />favor of all specific use permits coming to the Council instead of using <br />percentages. Mr. Cox noted that a particular zoning change had triggered <br />this discussion. There was consensus for the Ordinance to be amended. <br /> <br />The City Council delayed the discussion of two of the discussion items <br />until the December 10 meeting. They are discussions regarding (1) duplex <br />regulations and direction to Staff; and (2) building heights in the <br />Central Business Area (CBA) and direction to Staff. <br /> <br />Mayor Chiu introduced a discussion regarding the Solid Waste Contract and <br />direction to Staff. Ms. Hughson stated the Contract comes up in the <br />Summer of 2002, and the City needs to give 180-day notice to BFI if the <br />City is going to accept bids. She stated we have had this Contract for <br />two five year time periods, and she thinks it is time to rebid, and <br />perhaps the City will get a better deal, even if we eventually award to <br />the same contractor.
