He has reviewed the issues/options book provided by the <br />Staff and referenced the option to postpone the annexation until the new <br />laws are in effect after January, 2002. He stated they would be getting <br />nothing in return for the taxes they would pay and does not think this is <br />fair. (10) Miles Wilson requested the Council vote to defer the <br />annexation. He requested the Council consider that most of the residents <br />of the annexation area are opposed to the annexation and are not given a <br />voice in the decision-making. He stated postponement of this annexation <br />will not cause the City any harm, and could still be annexed prior to the <br />laws that will be in effect January, 2003. He stated there is no case law <br />in this area, and he thinks the Attorney General needs to provide an <br />interpretation. (11) Sherwood Bishop stated that two years ago the City <br />adopted the Edwards Aquifer Ordinance, and this year the Ordinance was <br />refined. The Ordinances of the City only cover the City and <br />extraterritorial jurisdiction. There are no limitations for water users <br />beyond those boundaries as to what can be constructed over the recharge <br />area. Mr. Bishop stated it is important to pass this annexation. He <br />stated the City's long-term plans for water include surface water. The <br />City receives federal funding according to population, and could have been <br />receiving additional funds had this area been annexed years ago. (12) <br />Bobby Whiteside stated the residents of the annexed area will not be <br />getting anything but will get to pay taxes. He wants to know what the <br />City can give back for the taxes they will pay. He stated he appreciates <br />the Council and the time spent on City matters, but if the Council votes <br />for this annexation, he does not know how they can sleep at night. He <br />stated the City does not need to get larger. He stated if the City is not <br />going to provide them services, then vote no on this annexation. (13) Bob <br />Sappington stated he has attended the meetings regarding this annexation. <br />He has lived in the extraterritorial jurisdiction of San Marcos since 1988 <br />and expected the City to eventually annex this area. He was surprised how <br />long it took. He tells others he lives in San Marcos, and feels everyone <br />needs to support San Marcos. He stated the Council needs to look at <br />things in a long-term manner, and he is speaking in favor of the <br />annexation. Mr. Sappington stated this issue will solve voter apathy, as <br />more will be interested in City government. <br /> <br />Mayor Pro-Tern Jane Hughson introduced Item 11 on the agenda, an Executive <br />Session pursuant to the Government Code, Section 551.071, to discuss <br />Wastewater Mandatory Connection Ordinance; and Sections 551.072 and <br />551.073, to discuss purchase of real property (Post Road area). Ms. Tatum <br />moved the Council adjourn into Executive Session at 7:52 p.m. and Mr. <br />Mayhew seconded the motion, which passed unanimously (Mayor Chiu not <br />present during the discussion regarding the Wastewater Mandatory <br />Connection Ordinance [disclosure affidavit-real property] and Mr. Montoya <br />was not present during the discussion regarding purchase of real property <br />-Post Road area [disclosure affidavit-real property]). <br /> <br />Ms. Tatum moved the Council reconvene at 9:00 p.m. and Mr. Mihalkanin <br />seconded the motion, which passed unanimously.
