<br />149. <br /> <br />Regular Meeting <br /> <br />November 26, 2001 <br /> <br />Page 5 <br /> <br />law provides for those on boards to remain serving until reappointed or <br />replaced. <br /> <br />Mayor Chiu introduced for consideration approval of two appointments to <br />the Hispanic Chamber of Commerce Board of Directors. Ms. Hughson moved to <br />appoint Mr. Montoya to represent the City Council regarding Tourism and <br />Mr. Mayhew moved to appoint Mr. Cox to represent the City Council <br />regarding Economic Development. On roll call of these two appointments, <br />the following vote was recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Hughson, Chiu, Cox, Mayhew, Tatum. <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: <br /> <br />Montoya. <br /> <br />Mayor Chiu introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 114.578 OF THE ZONING CHAPTER OF THE CITY CODE TO <br />REVISE REGULATIONS PERTAINING TO ALCOHOLIC BEVERAGE SPECIFIC USE <br />PERMITS IN THE CENTRAL BUSINESS AREA ZONING DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />Tom Wassenich stated his only concern was the need for this to be closely <br />monitored. He stated there needs to be tight rules; otherwise he has no <br />objection. Lupe Carbajal stated he is for this change. He stated there <br />are two contracts pending for restaurants that want to locate in the CBA <br />and sell alcoholic beverages. He requested the Council vote for this <br />amendment. No one else wished to speak, so Mayor Chiu closed the public <br />hearing. Ms. Hughson moved for approval of the Ordinance on first reading <br />and Mr. Mihalkanin seconded the motion. Mr. Mayhew asked who will enforce <br />this amendment and Mr. Gilley advised it will be the Planning and <br />Development Department. Mr. Mihalkanin stated the TABC will also monitor <br />this. He stated they have strict rules regarding restaurant food/alcohol <br />percentages. Ms. Hughson stated since TABC has rules monitoring how much <br />sales in food/alcohol, she wants the process of those receiving an SUP to <br />send the city a copy of the TABC report to be a part of our Ordinance. <br />Since the TABC reporting is not currently in the ordinance, Ms. Hughson <br />asked Mr. Taylor what is different now from ten years ago when this was <br />first discussed. Mr. Taylor stated annual reports and percentages are <br />required for businesses operating as a restaurant. Mr. Taylor stated a <br />copy of the TABC reports might be useful but advised to stay away from <br />percentages in the ordinance. Ms. Hughson asked if violations will be <br />found mostly by complaint, and Mr. Taylor advised by complaints and <br />through routine checks. Ms. Hughson inquired as to the number of bars <br />allowed and stated there was a consensus of Council that as bars close, <br />they were not to be replaced except as a restaurant with alcohol.
