Regular Meeting November 26, 2001 Page 6 Hughson stated the Council wanted identification of which of the 15 permits were bars, and if the number was less than 15, then the number of bars allowed be automatically reduced to the highest number of bars we have had since the law doesn't allow for stricter rules. It is the Council's intention for a bar to be allowed to transfer its permit, but if a bar closes the number of bars allowed will be reduced. Mr. Gilley stated Staff will go on site to determine how many bars are operating. Mr. Taylor will provide language for the Council to consider. The Council voted unanimously for approval of the Ordinance on first reading. Mayor Chiu introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 1,448.06 ACRES, MORE OR LESS, LOCATED OFF OF IH35 NORTH, NORTH OF THE BLANCO RIVER, INCLUDING THE CHAMPIONS CROSSING AND SADDLEBROOK SUBDIVISIONS (NORTH IH35 TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. Ms. Hughson stated she would abstain from consideration of this Ordinance, as family members own property across the street from this area. Mr. Mayhew moved for approval of the Ordinance on first reading and Mr. Mihalkanin seconded the motion. On roll call the following vote was recorded: AYE: Mihalkanin, Montoya, Chiu, Cox, Mayhew, Tatum. NAY: None. ABSTAIN: Hughson. Mayor Chiu introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 15.31 ACRES, MORE OR LESS, LOCATED ADJACENT TO THE 1600-1700 BLOCKS OF POST ROAD (BERRY TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. Mr. Montoya filed a disclosure affidavit-real property and left the Chambers during consideration of this Ordinance. Mr. Cox moved for approval of the Ordinance on first reading and Ms. Tatum seconded the motion. On roll call the following vote was recorded: AYE: Mihalkanin, Hughson, Chiu, Cox, Mayhew, Tatum. NAY: None.
