Proposed 2019-2022 Meet and Confer Agreement <br />Between the San Marcos Police Officers' Association and the City of San Marcos, Texas <br />Eligible for up to two extra duty assignments/compensation from Section 5(B)(3) Extra Duty <br />Assignment. <br />Section 6. On Call <br />Effective on the date of this Agreement Officers assigned to Narcotics or to Criminal Investigations who are <br />assigned to be on rotating on call and will receive additional compensation in the amount of forty dollars <br />($40.00) per month. <br />Section 7. Bilingual Pay <br />Effective on the date of this Agreement Bilingual pay will be paid at the rate of $40.00 per month for Officers <br />certified under standards established by the Chief and assigned to the bilingual program. The bilingual <br />program shall include and is limited to Spanish and sign language for the deaf. Officers will not be paid <br />cumulatively if they are certified in both. <br />Section 8. Implementation/Administration <br />The City shall establish procedures for the administration of premium pay. Police Officers are responsible <br />for submitting a request for premium pay. Requests for Education or Bilingual pay must include transcripts <br />or documentation of eligibility to receive the pay. All certifications must be current to receive premium pa <br />It is expressly agreed and understood that the City reserves the right to prorate any monthly pay in biweekly <br />equivalents for twenty-four (24) pay periods. <br />Section 9. Premium Holidays <br />A. The following Holidays will be recognized as "Premium Holidays": New Year's Day, 4th of July, <br />Thanksgiving Day and Christmas Day. <br />B. Officers assigned to the Patrol Division whose assigned shift begins within the 24-hour period on which <br />the actual holiday falls, will be paid 1 % time pay for that shift. <br />C. Officers working an overtime shift are not entitled to additional compensation. In no case will an <br />employee be paid at a rate more than 1 % times. <br />D. This section is in addition to the holiday provision in the Employee Handbook. <br />Section 10. Acting Pay for Corporal's <br />In the absence of the Sergeant, a Corporal may be asked to act in their place. When this acting duty is <br />anticipated to last a full pay period or more, the Corporal will be compensated at sergeant pay. When the <br />sergeant who is out on leave returns for one day or less, this shall not be considered a break in the absence <br />to end the acting pay. <br />Section 11. Statutory Preemption <br />This Article preempts any conflicting state statutes (including Texas Local Government Code Chapters <br />141, 142, and Chapter 143, Sections 143.038, 143.041(b), 143.041, 143.042, 143.044, and 143.047), local <br />ordinances, executive orders, civil service provisions, or rules adopted by the Chief of Police or City or by <br />any division or agent of the City, including any City personnel board and the Firefighters and Police Officers <br />Civil Service Commission, as provided by Texas Local Government Code Section 142.067. <br />
