Proposed 2019-2022 Meet and Confer Agreement <br />Between the San Marcos Police Officers' Association and the City of San Marcos, Texas <br />2. Guidelines: <br />a. The lateral entry program is for pay purposes only and actual work experience in another <br />law enforcement agency will not be considered for promotional eligibility requirements. <br />b. The Chief of Police shall determine eligibility for lateral entry of police applicants. Eligible <br />applicants may be placed up to Step 19.03 of the pay schedule. Officers placed through <br />this lateral entry program will progress through the remaining steps as he/she completes <br />years of service. <br />c. Longevity pay will be calculated in the same manner as all Police Officers. No credit will <br />be given to completed years of service in other law enforcement agencies. <br />d. Entry-level police officers placed up to Step 19.03 of the pay schedule must also complete <br />a new hire probationary period as outlined in Article 4. <br />e. The Chief of Police's determination of whether an applicant meets the criteria of the <br />lateral entry program and placement in the pay structure shall be final and non -appealable <br />to the Civil Service Commission, arbitrator or to any court. <br />G. The Chief may appoint part-time police officers for limited purposes which will not be members of <br />the classified service at appointment and will not have the protections of civil service at <br />employment or for the duration of employment. Part-time officers shall not work more than 1000 <br />hours per year and not more than 30 hours in any week unless approved by the Director of Human <br />Resources, or their designee, in writing. <br />Section 2. Eligibility List <br />A. This Article shall supersede Section 143.025 of the Texas Local Government Code to allow for more <br />than one eligibility list to be in effect at the same time which subsequent list shall be utilized upon <br />the exhaustion or expiration of the prior list. <br />B. Additional points may be awarded only to an applicant with a passing score as follows: <br />Prior Experience: <br />Two (2) years prior civilian law enforcement experience 5 points <br />OR <br />Two (2) years prior honorable military experience <br />(Honorable discharge from United States Armed Forces) 5 points <br />*No cumulative points for law enforcement or military experience are allowed. The maximum total <br />additional points are five (5) points. <br />Additional points, if any, shall be added only to the applicant's passing score. <br />Section 3. Statutory Preemption <br />To the extent that any of these provisions are in conflict with the TLGC Chapter 141, 152 or 143, this <br />provision shall prevail. <br />Page 4 <br />
