FRANCHISES AND PUBLIC SERVICE COMPANIES UT!LfffES <br />Sec. 11.01. Definitions: pPowers of the city council. <br />(a) In this article: <br />(1) "Public service company" means any company individual partnership, <br />corporation or other entity recognized by law that uses the city's streets alleys <br />highways or other public property to cam out its principal purposes including but <br />not limited to public utilities, commercial railway or street railway services public <br />transit services, solid waste collection, and vehicles for hire. <br />(2) "Public utility" means any water, wastewater, gas, electricity or <br />telecommunications utility that operates or offers service in the city. <br />(3) "Telecommunications utility" includes any company that provides or offers to <br />provide telephone, cable television or other similar services for the transmission of <br />voice. data or video information. <br />The city council has the following powers regarding public service companies <br />utilities of every character operating in the city: <br />(1) To buy, condemn, construct, lease, maintain and operate public utility systems in <br />the city; <br />(2) To sell, manufacture and distribute the services and output of city public utility <br />systems; <br />(3) To prohibit the use of city streets, alleys, easements or other grounds by a public <br />service comp anX utility unless the compM u dirty first obtains a franchise,, permit <br />certificate or other authorization in accordance with this article and applicable
