Mayor Pro-Tem Mihalkanin asked if the <br />Council permits a fence to be put up in an alley and a future Council decides that should not have <br />been done, then the City has the issue of cost. Mayor Pro-Tern Mihalkanin stated if the Council <br />was interested in directing staff to deal with this issue, what would be the process? Would it take <br />Council's direction to staff once it is known that a resident property owner needs access to an <br />alley, to administratively handle the matter, or direction to staff to send the appropriate <br />documents to the owner of the fence to remove it, so that the alley may be used? Mr. Taylor <br />stated there is no policy at this time and what is needed is direction to draft a new policy in <br />Ordinance form. The Council directed staff to establish a general policy and wants the resident <br />to have access to the alley. <br /> <br />Mayor Pro-Tern Mihalkanin introduced a discussion item regarding limit on alcoholic beverage <br />specific use permits in Central Business Area Zoning District. Mr. Taylor stated the agenda <br />request form summarizes the history where this began fifteen years ago. This Ordinance was <br />revised in 1994 to allow a limited change in the downtown specific use permits to occur through <br />the administrative process rather than going through the Planning and Zoning Commission. <br />Recently there has been an interest in relaxing the process further to allow other kinds of changes <br />administratively. If any change is made at this time the individual has to go through the whole <br />process and have their name on a waiting list. Ms, Hughson stated the Downtown Association <br />will meet tomorrow and will discuss this issue and would like to know what the Association's <br />recommendations will be. Mr. Hernandez asked how many businesses are currently on the <br />waiting list and Mr. Patterson replied three. Ms. Hughson asked if the waiting list consists of <br />new businesses and Mr. Patterson replied yes, and that they have been waiting for several <br />months, Mr. Hernandez stated if the business is already established and would like to sell or if <br />the business wants to upgrade or downgrade, there should be a better process for these <br />individuals. Mr. Cox stated the restaurants should be considered separately. The Council <br />directed this item be placed on the next Regular City Council Meeting. <br /> <br />Mayor Pro-Tern Mihalkanin introduced the City Manager's Report. Mr. Gilley stated he had no <br />report at this meeting. <br /> <br />Mayor Pro-Tern Mihalkanin introduced the City Attorney's Report. Mr. Taylor stated he had no <br />report at this meeting. <br /> <br />Mayor Pro-Tern Mihalkanin introduced the City Council's Report. Mr. Hernandez stated he <br />attended the TML Region VII Meeting in Live Oak and there was a good turn out of over one <br />hundred people attending the meeting. Mr. Moseley stated transportation is a very important <br />issue and he feels this needs to be a part of the Master Plan Study. The Census 2000 is going <br />well and Kate Elrod, Planning Department, is training to help individuals fill out their forms. <br />Ms. Hughson stated the long form for the Census has irritated a lot of people and they may not <br />want to complete it. We need to inform them if they need not fill out the complete form in order <br />to submit it. Mr. Cox stated the workshop to be held on April 24, 2000 is not enough time for <br />transportation issues to be discussed. Ms. Hughson suggested scheduling a separate workshop <br />for this particular issue. Mr. Cox stated the communication of the agendas to the public needs to <br />be printed in the newspaper and Ms. Hughson also asked for the agenda to be placed on Channel <br />16. Ms. Hughson stated she would like Council to suggest to TML that bylaws be changed so <br />that Hays County is included with other counties in the Central Texas Region. <br /> <br />Mayor Pro-Tern Mihalkanin introduced for consideration an Executive Session pursuant to the <br />Government Code, Section 551.071, to seek the City Attorney's advice regarding drainage utility <br />fees; Sector 5 Plan; development incentive proposals (Airport area; IH351W0nder World Drive <br />area). Mr. Moseley moved to adjourn into Executive Session at 11 :28 p.m. and Ms. Hughson <br />seconded the motion, which passed unanimously. <br /> <br />Mr. Hernandez moved to reconvene from Executive Session at 12:16 a.m. and Mr. Cox seconded <br />the motion, which passed unanimously. <br /> <br />Mr. Hernandez moved to adjourn the meeting at 12: 16 a.m. and Mr. Moseley seconded the <br />motion, which passed unanimously. <br />
