<br />61. <br /> <br />Regular Meeting <br /> <br />March 27, 2000 <br /> <br />Page 2 <br /> <br />Mayor Pro-Tern Mihalkanin introduced for consideration one appointment to the Convention and <br />Visitors Bureau. Ms. Hughson moved to appoint Marty Sorell (Neighborhood Association <br />representative) to fill a vacancy, which passed unanimously. <br /> <br />Mayor Pro-Tern Mihalkanin introduced for consideration one appointment to the San Marcos <br />Electrical Board. Mr. Doiron moved to appoint Delanie Broadwater (resident of the City) to fill a <br />vacancy, which passed unanimously. <br /> <br />Mayor Pro-Tern Mihalkanin introduced for consideration one appointment to the Arts <br />Commission. Mr. Moseley moved to appoint Adela Rojo to fill a vacancy, which passed <br />unanimously. <br /> <br />Mayor Pro- Tem Mihalkanin introduced for consideration one appointment to the Youth <br />Commission. Mr. Hernandez moved to appoint Kyev Tatum (representing the Mitchell <br />Opportunity Center) to fill a vacancy, which passed unanimously. <br /> <br />Mayor Pro-Tern Mihalkanin introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 6.135 ACRE TRACT OF PROPERTY LOCATED AT 201 MILL STREET FROM <br />"M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO <br />"MF-2" MULTI-FAMILY DISTRICT (MEDIUM DENSITY) AND BY REZONING AN <br />11.661 ACRE TRACT OF PROPERTY LOCATED AT THE REAR OF 201 MILL <br />STREET FROM "C" COMMERCIAL DISTRICT TO "MF-3" MULTI-FAMILY <br />DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />Mayor Pro-Tern Mihalkanin opened the public hearing and asked if anyone wished to speak. <br />Adam Gunther stated the Planning and Zoning Commission voted 7 to 1 in favor of this <br />development. The neighborhood is concerned the traffic flow would be increased because of this <br />project. Mr. Gunther met with the neighborhood representatives to ask what they would like to <br />see happen with the proposal and also met informally with the neighborhood regarding the site <br />plan. The neighborhood wants restrictions placed on the zoning and he is willing to place this <br />information in the contract with the Satterwhites. Claudia Marlow stated the Master Plan calls <br />for specific zoning and she would like for it to remain "c" and "M-2". Paul Lyon, a <br />representative of the Satterwhite family, stated the project is a reasonable request that has been <br />approved by the Planning and Zoning Commission and the developer has been honest with the <br />neighborhood on what would be done with this project. Lee Tatsch stated he is from the Mill <br />Street neighborhood and opposes this zoning change because there are currently too many <br />apartments in this neighborhood. John Crowley stated he opposes this project because there is <br />currently too much noise and traffic in this area. Ollie Giles stated she is a representative of all <br />Neighborhoods in San Marcos, asked the Council to vote against this project because the Master <br />Plan supports the neighborhoods. Isabel Garcia, a Mill View Neighborhood Representative, <br />stated her main concern was the Master Plan, which states should be "C" commercial and wants <br />to keep this parcel "C". Ms. Garcia gave the Council a handout from the internet and pointed out <br />that most of the apartment complexes are located in their area. Saul Gonzales, a Neighborhood <br />Representative, stated in the Sector Plan process there was agreement for PDD, and is the City <br />following through with this plan. Mr. Gonzales stated he took the amendments of the contract to <br />the neighborhood and they opposed the development of this project. Jacob Montoya stated he <br />resides on Post Road, across the street from where this development is to take place. He opposes <br />this development because traffic will be increased in the neighborhood once this project is <br />completed and the developer may say the traffic will not increase by very much, but the reality is <br />with all events at the stadium and other events in the city the traffic flow will increase. Ralph <br />Gonzales stated he has met with the neighborhood and it is a consensus of the people of this area <br />to not change the zoning. Janie Serrano stated there is currently an apartment complex in her <br />back yard and with the majority being college students, trash and loud parties are very common <br />in her neighborhood.
