Ms. Hughson also asked whether this would be temporary until the <br /> Wonder Wodd Extension is constructed. Mr. Gilley stated that was his understanding. Mr. <br /> Gilley stated regarding a compromise, it would probably be establishing a weight limit between <br /> 44-50,000 pounds. Mr. Gilley referred to Ms. Anderson's memo dated June 6, 2000. It stated <br /> the actual weight limitation is the easiest method of enforcement that can be used to determine <br /> visually whether or not the vehicles meet the restrictions. Mr. Gilley stated it makes the most <br /> sense in terms of prohibiting truck traffic. Mr. Doiron asked what sort of fines the Council <br /> would impose on limitations on the size of the trucks. Mr. Taylor stated the fine could be up to <br /> $500.00 per violation according to State law. Ms. Hughson asked what would be the notification <br /> for not driving trucks on Bishop. Mr. Gilley stated there really is no practical way of notifying <br /> the truckers. Ms. Hughson suggested notifying through the web site. Mayor Chiu suggested <br /> having signs at the corner of Ranch Road 12 and Bishop. Mr. Gilley stated there was no <br /> problem where the signs went. Mr. Doiron stated he felt uncomfortable in going anywhere <br /> above the 45,000 pound limit. Mr. Taylor stated the ordinance is set up to refer to Section 4 to <br /> our fine section which says that each violation is punishable by a fine of between $1.00 and <br /> $500.00. Mr. Taylor stated if the Council is interested in setting minimums it could be done as <br /> part of the City Code text where restrictions are. Mr. Doiron stated he would like it set at <br /> $500.00 minimum and $500.00 maximum for violations. Ms. Tatum stated she still had some <br /> concerns about the trucks and weight limits because of the hills on Bishop and for safety issues. <br /> Ms. Tatum stated she was concerned that a 45,000 pound truck going down a blind hill could do <br /> as much damage as a 200,000 pound truck because of the space on Bishop Street. Discussion <br /> ensued. The following vote was recorded on the motion to approve the Ordinance on second <br /> reading. <br /> AYE: Doiron, Hughson, Cox <br /> NAY: Moseley, Chiu, Mayhew, Tatum <br /> ABSTAIN: None <br /> Motion failed. <br /> Mayor Chiu introduced for consideration Item 10.C (1), adoption of a Resolution, removed from <br /> the consent agenda, the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE COMPOSITION OF AND THE CHARGE TO THE <br /> DEVELOPMENT ORDINANCE REVIEW TASK FORCE; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> Mr. Mayhew moved for approval of the Resolution and Mr. Cox seconded the motion. Ms. <br /> Hughson moved to amend Part 2 of the Resolution, paragraph two, to change the word "process" <br /> to processes and to add the following phrase after the word housing, "(including the appropriate <br /> role for manufactured housing)" as suggested by the City Attorney. Mr. Doiron seconded the <br /> motion which passed unanimously. The motion passed unanimously on the approval of the <br /> Resolution. <br /> Mayor Chiu introduced for consideration Item lO.C. (3), adoption of a Resolution, removed from <br /> the consent agenda, the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING AN INTERLOCAL AGREEMENT BETWEEN THE CITY <br /> AND THE LOWER COLORADO RIVER AUTHORITY FOR THE PROVISION OF <br /> TREE TRIMMING SERVICES; AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> Ms. Hughson moved for adoption of the Resolution and Mr. Doiron seconded the motion, which <br /> passed unanimously. <br />
