106 Regular Meeting June 26, 2000 Page 2 Mayor Chiu introduced for consideration two appointments to the Senior Citizens Advisory Board. Mr. Doiron moved to appoint Gil Peyton and Mr. Moseley moved to appoint Linus VVilks, which passed unanimously. Mayor Chiu introduced for consideration a public hearing and approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, RENEVVIKG THE EXISTING FRAt~CHISE AGREEMENT BETVVEEN THE CITY AND THE PEDERNALES ELECTRIC COOPERATIVE, INe.; REVISING THE METHODOLOGY FOR DETERMINING FRANCHISE FEE PAYMENTS; PROVIDING FOR VVRITTEN ACCEPTANCE TO BE FILED BY THE PEDERNALES ELECTRIC COOPERATIVE; AND PROVIDING AN EFFECTIVE DATE. Mayor Chiu opened the public hearing and asked if anyone wished to speak. Bill Cunningham, consultant for PEC, stated he would be present to answer any questions the Council may have. There were no other speakers, so Mayor Chiu closed the public hearing. Mr. Doiron moved for approval ofthe Ordinance on first reading and Ms. Tatum seconded the motion. Ms. Hughson asked how the rate was determined. Mr. Taylor stated the total kilowatt hours sold in the City in 1998 divided by the actual franchise fee payment to the City that year, which equals per kilowatt hours. The Council then voted unanimously for approval ofthe Ordinance on first reading. Mayor Chiu introduced for consideration an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AlVIENDING SECTION 2.333 OF THE CITY CODE TO REVISE THE DUTIES AND POVVERS OF THE AIRPORT COMMISSION; AND INCLUDING PROCEDURAL PROVISIONS. Mr. Moseley moved for approval of the Ordinance on first reading and Mr. Cox seconded the motIon. Ms. Hughson asked if the Airport Commission had reviewed this and made a recommendation. Mr. Gilley stated the Airport Commission had not reviewed this information. Mayor Chiu stated the City has an Airport Manager, and Mr. Doughty prepares the Airport budget. The Commission makes budget recommendations, and Mr. Gilley actually prepares the budget submitted to Council. Ms. Hughson moved to amend by not striking Section 2.333 and insert "will review and" between the words "commission" and submit"and Mr. Doiron seconded the motion, which passed unanimously. On the main motion the Council voted unanimously for approval of the Ordinance on first reading. Mayor Chiu introduced for consideration reconsideration of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 22.8 ACRE TRACT OF PROPERTY LOCATED IN THE 1500 BLOCJC OF IH-35 SOUTH FROM "I" INDUSTRIAL DISTRICT TO "MF -2" MUL TI-F AMIL Y DISTRICT (MEDIUM DENSITY) AND BY REZONING 4.340 AND 2.847 ACRE TRACTS OF PROPERTY LOCATED IN THE 1500 BLOCJC OF IH-35 SOUTH FROM "I" INDUSTRIAL DISTRICT TO "C" COMMERCIAL DISTRICT INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. The Council did not wish to reconsider this item. Mayor Chiu introduced for consideration the consent agenda, including approval of the Minutes of the Regular Meeting held June 12,2000, approval of two Ordinances on second reading, remove fTOm the table and adoption of a Resolution, and adoption of six Resolutions. The Council removed Items 8.e., remove from the table and adoption of a Resolution; Item S.D. (2) and S.D. (5), adoption of Resolutions, to be considered separately.
