<br /> 3. <br />Regular Meeting September 25, 2000 Page 3 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 57.47 ACRE <br /> TRACT OF PROPERTY LOCATED TO THE NORTHEAST OF THE 700 AND 800 BLOCKS <br /> OF CIVIC CENTER LOOP, FROM" LB" (LIMITED BUSINESS DISTRICT) AND" LI" <br /> (LIGHT INDUSTRIAL DISTRICT) TO" MF-4" (MULTI-FAMILY DISTRICT [HIGH <br /> DENSITY] ), AND BY REZONING A 3.76 ACRE TRACT OF PROPERTY LOCATED TO <br /> THE NORTHEAST OF THE 700 AND 800 BLOCKS OF CIVIC CENTER LOOP, FROM <br /> "PD" (PRE-DEVELOPMENT DISTRICT) TO "LI" (LIGHT INDUSTRIAL DISTRICT); <br /> INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />Steve Ramsey of Baker-Aiklen was present to represent the applicant. He <br />stated the applicant's request is consistent with the Sector 5 Plan and <br />received a unanimous vote of approval by the Planning and Zoning <br />Commission. No one else wished to speak, so Mayor Chiu closed the public <br />hearing. Mr. Doiron moved for adoption of the Zoning Ordinance and Mr. <br />Moseley seconded the motion, which passed unanimously. <br />Mayor Chiu introduced a public hearing and adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID <br /> WASTE AND RECYCLABLE MATERIALS; INCLUDING PROCEDURAL PROVISIONS AND <br /> DECLARING AN EMERGENCY. <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Chiu closed the public hearing. Mr. Cox moved for <br />adoption of the Ordinance on emergency and Mr. Moseley seconded the <br />motion. Ms. Hughson inquired why the matter was on emergency. Ms. <br />Huffman advised the Council the City received a letter from BFI on <br />September 6, and in order to begin a rate increase and collection by <br />October 1, the matter needed to be presented on emergency. Jack Clements <br />of BFI advised the Council the request is based on the month of May CPI. <br />They do not receive the June CPI until the middle of July. When they <br />receive the statistics, they inform the City Manager before bringing the <br />matter forward; and they act as soon as they receive the numbers from <br />their Ft. Worth office. Mr. Cox stated when BFI is unable to meet with <br />Mr. Gilley, they should meet with another staff member so as not to delay <br />the matter. Ms. Hughson noted BFI can use April data to meet their <br />contract deadline in future years. Mr. Moseley stated he wanted to <br />consider the Ordinance on three readings. Mr. Cox stated he was <br />comfortable considering this Ordinance on emergency because he does not <br />want to punish BFI, and does want them to do this matter more timely next <br />year. Mr. Moseley moved to amend the Ordinance to be considered on three <br />readings and Mr. Mayhew seconded the motion. On roll call the following <br />vote was recorded: <br />AYE: Doiron, Moseley, Hughson, Chiu, Mayhew, Tatum. <br />
