Ill. City's Duties - Design and Bidding Phase of the Project. <br />3.1 City shall pay Baker Aicklen & Associates, Inc. for the design of the Project with <br />Community Development Block Grant Funds ("CDBG Funds") <br />3.2 City staff shall assist Baker Aicklen & Associates, Inc. in the preparation of bid <br />documents and a construction contract(s) (the "Construction Contract") to allow <br />The Village to award a competitively bid contract for construction of the Project. <br />Approval of the bid documents by resolution of the Board of Directors of the <br />Village shall be required prior to bidding the Project. <br />3.3 The City shall ensure via the terms and conditions of its agreement(s) with The <br />Village that the bid documents and the Construction Contract shall: <br />a. require payment and performance bonds, insurance, and all other terms and <br />conditions that the City would include in a public park construction contract if the <br />City were bidding the Project for its own account, as owner, using CDBG Funds <br />and in accordance with all applicable federal and state laws and city ordinances; <br />b. require compliance with the Davis-Bacon Act by the Contractor and any <br />subcontractors; <br />c. provide that the sole source of funds to be paid to the Contractor are the proceeds <br />of the County's bond sale, authorized by the voters of Hays County, Texas, in an <br />amount not to exceed $1,618,417; <br />d. detail the priority of construction phasing with the completion of the football fields <br />being the first priority;
