e. provide for recreational amenities to be bid as add alternates. Recreational <br />amenities shall include picnic tables, park benches, park grills, playscape <br />components, %i court basketball surface, and the pavilion; <br />f. require Contractor to submit two (2) sets of payment draw forms to the Project <br />Engineer with invoices attached; <br />g. provide that approval of the Project Engineer, the Village, the City and the County <br />is required on each payment draw before payment will be made; <br />h. require ten percent (10%) retainage by the County on each payment submitted by <br />the Contractor; <br />i. provide that approval by the Village, the County, and the City is required for <br />release of retainage and that the signature of Hays County's Special Counsel and <br />the Hays County Auditor is required for processing of the final pay request; <br />j. provide that neither Hays County, Texas nor the City of San Marcos, Texas shall <br />control the method or means of performance of the work by the Contractor and <br />any subcontractors; and <br />k. shall state that Contractor is an independent contractor of The Village of San <br />Marcos, Inc. <br />3.4 City staff will assist the Board of Directors of The Village in opening of sealed <br />competitive bids, evaluating the responsiveness of the bids received, and <br />determining the ability of the lowest responsible bidder to complete the Project on <br />time and on budget. The Board of Directors of The Village will approve the award <br />of the Construction Contract.
