12. <br />Regular Meeting January 14, 2002 Page 12 <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on third and final <br />reading and Mr. Montoya seconded the motion. The Council listened to <br />comments and requests of clarifications from several wrecker service <br />companies. Mr. Mayhew moved to amend Section 90.252(b) to read,"If a <br />complaint pertains to damages allegedly caused to a vehicle in the course <br />of a police-authorized tow, the chief of police will determine whether the <br />rotation wrecker service involved should pay the damages as a condition of <br />continuing on the rotation system. If the chief determines that damages <br />should be paid, the service must either 1) pay the damages within 15 days <br />of the police chief's decision, or 2) file a claim with service's <br />insurance company within three business days after being notified of the <br />chief's decision, with payment to be made within 45 calendar days after <br />the chief's decision~.., Mr. Mihalkanin seconded the motion, which passed <br />unanimously. Ms. Hughson moved to add the "and firefighters~ to Section <br />90.247, to add "or firefighter~ in Section 90.247(a), and in Section <br />90.223 add "or lienholder~ to the definition of consent tow, and Mr. <br />Mayhew seconded the motion, which passed unanimously. Mr. Mihalkanin <br />moved to amend Section 90.291(a) Category A, Service Description 3. <br />Maximum fee to "$70.00", and Mr. Cox seconded the motion. On roll call <br />the following vote was recorded: <br /> <br />AYE: Cox, Mihalkanin. <br /> <br />NAY: Mayhew, Tatum, Montoya, Hughson. <br /> <br />ABSTAIN: None. <br /> <br />(Mayor Chiu not present during this vote.) Motion failed. The Council <br />then voted unanimously for adoption of the Ordinance on third and final <br />reading. <br /> <br />Mayor Chiu introduced for consideration approval of minutes of the Regular <br />Meeting held December 10, 2001 and December 17, 2001, approval of one <br />Ordinance on second reading; adoption of three Ordinances on third and <br />final reading, adoption of seven Resolutions and approval of one motion to <br />accept payment in Lieu of Taxes by the Housing Authority on consensus. <br />The City Council removed Items 20 and 21, adoption of Resolutions, to be <br />considered separately.
