The Council listened to comments and requests of clarifications from several wrecker service companies. Mr. Mayhew moved to amend Section 90.252(b) to read,"If a complaint pertains to damages allegedly caused to a vehicle in the course of a police-authorized tow, the chief of police will determine whether the rotation wrecker service involved should pay the damages as a condition of continuing on the rotation system. If the chief determines that damages should be paid, the service must either 1) pay the damages within 15 days of the police chief's decision, or 2) file a claim with service's insurance company within three business days after being notified of the chief's decision, with payment to be made within 45 calendar days after the chief's decision~.., Mr. Mihalkanin seconded the motion, which passed unanimously. Ms. Hughson moved to add the "and firefighters~ to Section 90.247, to add "or firefighter~ in Section 90.247(a), and in Section 90.223 add "or lienholder~ to the definition of consent tow, and Mr. Mayhew seconded the motion, which passed unanimously. Mr. Mihalkanin moved to amend Section 90.291(a) Category A, Service Description 3. Maximum fee to "$70.00", and Mr. Cox seconded the motion. On roll call the following vote was recorded: AYE: Cox, Mihalkanin. NAY: Mayhew, Tatum, Montoya, Hughson. ABSTAIN: None. (Mayor Chiu not present during this vote.) Motion failed. The Council then voted unanimously for adoption of the Ordinance on third and final reading. Mayor Chiu introduced for consideration approval of minutes of the Regular Meeting held December 10, 2001 and December 17, 2001, approval of one Ordinance on second reading; adoption of three Ordinances on third and final reading, adoption of seven Resolutions and approval of one motion to accept payment in Lieu of Taxes by the Housing Authority on consensus. The City Council removed Items 20 and 21, adoption of Resolutions, to be considered separately. Mr. Montoya moved for approval of minutes of the Regular Meetings held December 10, 2001 and December 17, 2001, approval of the Ordinance on second reading, adoption of three Ordinances on third and final reading, adoption of the remaining five Resolutions, and approval of the Motion to accept payment in Lieu of Taxes by the Housing Authority on consensus and Ms. Hughson seconded the motion, which passed unanimously. The captions of these Ordinances and Resolutions read as follows: Approval of Ordinance on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, DEDICATING VARIOUS TRACTS OF REAL PROPERTY IN THE CITY FOR PARK PURPOSES; AND INCLUDING PROCEDURAL PROVISIONS.
