<br />8. Amend Section 7.03 ref!ardinf! the City master plan as follows: <br /> <br />Sec. 7.03. The master plan. <br /> <br />illL The master plan for the City of San Marcos shall be used to guide the growth and <br />development of the city. The master plan shall be adopted by ordinance. The city council <br />will endeavor to ensure that All city ordinances governing growth and development are shaH <br />be consistent with the goals and policies contained in the master plan; however. land use <br />maps and descriptions contained in the master plan do not constitute zoning. and do not <br />entitle any property owner to any change in zoning. <br /> <br />(Q} The commission shall conduct an ongoing review of the plan in accordance with Section <br />7.02. The commission may recommend amendments to the master plan after at least one <br />public hearing on the proposed action. The council may amend the master plan after at least <br />one public hearing on the proposed action. The council shall not act on any amendment <br />affecting the master plan unless and until a recommendation on the amendment is received <br />from the commission. <br /> <br />********* <br /> <br /> <br />Rationale: The City's master plan is the foundation of the City's land use and development policies. <br />The current master plan, San Marcos Horizons, was developed through a broad-based committee of <br />community representatives, and it embodies the City's goals and aspirations concerning the future <br />of the City. The land use maps of the master plan serve as an important guide for property owners, <br />developers and neighbors about the future use of property. However, the land use maps do not <br />constitute zoning and they are not binding on the City or on property owners. Zoning of property can <br />only occur after detailed procedural requirements are complied with, including public notices and <br />public hearings, and in some cases, the need for approval by an extraordinary majority of the <br />planning and zoning commission or city council. The current language of this charter section can <br />give rise to expectations that a change in zoning is either guaranteed or prohibited, even before <br />public notice and public hearing processes have taken place. <br /> <br />9. Amend Section 8.02 ref!ardinf! the annual budf!et policy statement as follows: <br /> <br />Sec. 8.02. Preparation and submission of budget. <br /> <br />The city manager, not less than 30 days prior to the time the city council makes its tax levy <br />for the current fiscal year, shall file with the city clerk a proposed budget, which budget shall <br />provide a complete financial plan for the fiscal year, and shall contain a budget message, <br />explanatory of the budget, which shall contain an outline of the proposed financial policies of <br />the city for the ensuing fiscal year, shall set forth the reasons for salient changes from the <br />previous fiscal year in expenditure and revenue items, and shall explain any major changes in <br />financial policy. <br /> <br />C:\TEMP\charter commission report-2001.doc <br /> <br />7 <br />
