<br />regulating the holding of municipal elections and in accordance with the ordinances adopted <br />by the city council for the COllduct of elections. Provided that tIhe city council shall appoint <br />the election judges and other election officials. Voting precincts shall be established by <br />ordinance and may be altered from time to time in like manner. <br /> <br />3. Amend Section 6.03 as follows: <br /> <br />Sec. 6.03. Forms of petitions. <br /> <br />Initiative petition papers shall contain the full text of the proposed legislation in the <br />form of an ordinance, including a descriptive caption. Referendum petition papers shall <br />contain a sufficient description of the ordinance sought to be referred to identify it, or if the <br />ordinance has been passed by the council, the full text of the ordinance sought to be referred <br />shall be included in such papers. The signatures to the initiative or referendum petitions need <br />not be all appended to one paper, but each signer shall sign his or her name in ink or indelible <br />pencil, together with a notation showing residence address and voter registration number. No <br />signature shall be counted where there is reason to believe it is not the actual signature of the <br />purported signer or that it is a duplication either of name or of handwriting used in any other <br />signature on the petition, and no signature shall be counted unless it is accompanied by all <br />of the information required by applicable state law. Before signatures on any petition paper <br />may be counted, one of the signers of such petition paper, a qualified voter, shall make oath <br />or affirmation before the city clerk or any other officer competent to administer oaths or <br />affirmations, that the statements made therein are true, that each signature to the paper <br />appended is the genuine signature of the person whose name purports to be signed thereto, <br />and that such signatures were placed thereon in that person's presence. <br /> <br />4. Amend Section 9.03 as follows: <br /> <br />Sec. 9.03. Misapplication of bond funds. <br /> <br />Any officer or employee of the City of San Marcos who shall willfully wilfully or knowingly <br />divert or use any funds arising from the issuance of any bond or sinking fund for any other <br />purpose than that for which the fund is created or as herein otherwise authorized, shall be <br />subject to prosecution as provided by the laws of the State of Texas on the diversion and <br />conversion offunds belonging to any of the municipalities of the State of Texas. <br /> <br />c. OTHER RECOMMENDATIONS <br /> <br />The Commission recommends that the proposed budget for each fiscal year (mentioned in Charter <br />Section 8.02), the adopted budget for each fiscal year (mentioned in Charter Section 8.05), and the <br />bond register for the City (mentioned in Charter Section 9.02) be made available to the public, if <br />possible, via Internet at the City's web site. <br /> <br />C:\TEMP\charter commission report-200l.doc <br /> <br />9 <br />
