Ms. Narvaiz moved the Council adjourn into <br />Executive Session pursuant to the Government Code, Section 551.074, to <br />discuss the duties of Public Officers (Planning and Zoning Commission), at <br />7:50 p.m. and Mr. Mayhew seconded the motion, which passed unanimously. <br /> <br />Mr. Mihalkanin moved the Council reconvene at 8:33 p.m. and Ms. Narvaiz <br />seconded the motion, which passed unanimously. <br /> <br />On roll call for the adoption of the Ordinance on emergency, the following <br />vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Habingreither and Taylor. <br /> <br />NAY: <br /> <br />Mihalkanin, Montoya, Mayhew and Tatum. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />The motion for the adoption of the Ordinance failed. <br /> <br />Mayor Habingreither introduced for consideration removal from table and <br />adoption of an Ordinance on emergency, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID <br />WASTE AND RECYCLABLE MATERIALS; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mr. Mihalkanin moved to remove the Ordinance from the table, and Ms. Tatum <br />seconded the motion, which passed unanimously. Mr. Mayhew moved for <br />adoption of the Ordinance and Ms. Narvaiz seconded the motion. Ms. Tatum <br />inquired if the City would have trash pick up on September 1, 2002. Mr. <br />O'Leary stated there would be trash pick up on September 1, 2002 and this <br />temporary contract will be on a month-to-month basis with an option to <br />renew up to a year.
