176. Regular Meeting August 12, 2002 Page 3 Mayor Habingreither introduced a public hearing regarding the proposed FY2002-2003 Budget. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. 1) George Von der Lippe stated he wanted to commend the City Council and Staff for developing the street proposal as a priority and invited the Council to meet with the Bond Advisory Committee. No one else wished to speak, so Mayor Habingreither closed the public hearing. Ms. Narvaiz thanked the Staff for coming together in such a critical time and finding money to balance the budget. Mayor Habingreither thanked Mr. O'Leary for his leadership with a balanced budget. Mayor Habingreither introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 24.09 ACRE TRACT OF PROPERTY LOCATED OFF OF THE 1600 BLOCK OF BROWN STREET FROM "PD" PRE-DEVELOPMENT DISTRICT, "R-l" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) AND UNZONED TO "PDD" PLANNED DEVELOPMENT DISTRICT (BASE ZONING R-l DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. 1) Susan Landreth stated she is with the firm of Byrn & Associates and was available to answer any questions. No one else wished to speak, so Mayor Habingreither closed the public hearing. Ms. Tatum moved for the adoption of the Zoning Ordinance and Mr. Mayhew seconded the motion. Mr. Taylor stated maps 8 and 9 show Lot 9 is in a recharge area and he wanted to know if there was a need to protect this area, and was advised it is in a protected zone. The vegetation remains natural, and there will be no alteration of the terrain. Mr. Taylor also asked if Lot 8 (that contains a 4 foot cave 15 feet deep) on the recharge zone is protected, and Ms. Landreth advised it is also protected. Ms. Landreth stated there is a need to protect this area for geological features, which is why this lot is labeled Protective Zone. Mr. Mihalkanin asked for the meaning of Protective Zone. Ms. Landreth stated a protected zone lot means no construction, clearing or altering in any way. She also stated this would be part of the Deed Restrictions and part of the "PDD". Ms. Landreth stated the cave itself has a minor sensitivity and is too narrow for anyone or anything to enter. The Council then voted unanimously for the adoption of the Zoning Ordinance. Mayor Habingreitherintroduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 2.091 OF THE CITY CODE TO REVISE THE COMPOSITION OF THE PLANNING AND ZONING COMMISSION; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY.
