Mayor Habingreither opened the public hearing and asked <br />if anyone wished to speak. 1) George Von der Lippe stated he wanted to <br />commend the City Council and Staff for developing the street proposal as a <br />priority and invited the Council to meet with the Bond Advisory Committee. <br />No one else wished to speak, so Mayor Habingreither closed the public <br />hearing. Ms. Narvaiz thanked the Staff for coming together in such a <br />critical time and finding money to balance the budget. Mayor Habingreither <br />thanked Mr. O'Leary for his leadership with a balanced budget. <br /> <br />Mayor Habingreither introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 24.09 ACRE <br />TRACT OF PROPERTY LOCATED OFF OF THE 1600 BLOCK OF BROWN STREET FROM <br />"PD" PRE-DEVELOPMENT DISTRICT, "R-l" SINGLE-FAMILY DWELLING DISTRICT <br />(LOW DENSITY) AND UNZONED TO "PDD" PLANNED DEVELOPMENT DISTRICT (BASE <br />ZONING R-l DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished to <br />speak. 1) Susan Landreth stated she is with the firm of Byrn & Associates <br />and was available to answer any questions. No one else wished to speak, so <br />Mayor Habingreither closed the public hearing. Ms. Tatum moved for the <br />adoption of the Zoning Ordinance and Mr. Mayhew seconded the motion. Mr. <br />Taylor stated maps 8 and 9 show Lot 9 is in a recharge area and he wanted <br />to know if there was a need to protect this area, and was advised it is in <br />a protected zone. The vegetation remains natural, and there will be no <br />alteration of the terrain. Mr. Taylor also asked if Lot 8 (that contains a <br />4 foot cave 15 feet deep) on the recharge zone is protected, and Ms. <br />Landreth advised it is also protected. Ms. Landreth stated there is a need <br />to protect this area for geological features, which is why this lot is <br />labeled Protective Zone. Mr. Mihalkanin asked for the meaning of <br />Protective Zone. Ms. Landreth stated a protected zone lot means no <br />construction, clearing or altering in any way. She also stated this would <br />be part of the Deed Restrictions and part of the "PDD". Ms. Landreth stated <br />the cave itself has a minor sensitivity and is too narrow for anyone or <br />anything to enter. The Council then voted unanimously for the adoption of <br />the Zoning Ordinance. <br /> <br />Mayor Habingreitherintroduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 2.091 OF THE CITY CODE TO REVISE THE COMPOSITION OF <br />THE PLANNING AND ZONING COMMISSION; INCLUDING PROCEDURAL PROVISIONS; <br />AND DECLARING AN EMERGENCY. <br />
