She <br />stated the current Ordinance allows a specific number of signs. Mr. <br />Patterson stated the current Ordinance restricts what roads can be used for <br />placement of off-premise signs. He stated the Ordinance adopted in 1989 <br />does not meet the current spacing regiment. He stated there is a provision <br />allowing wooden off-premise signs to be restructured to a metal monopole <br />support. Mr. Mihalkanin inquired whether there are signs the City has no <br />record of. Mr. Patterson stated there are some signs, which were <br />constructed before 1989, which may be illegal. There may be some property <br />owners valid permit from TxDOT for some locations. Mr. Mihalkanin asked <br />what is the effect on the sign moratorium. Mr. Mark Taylor stated the <br />moratorium would continue. Mr. Mihalkanin stated he is in favor of tabling <br />this matter to the next Regular Council Meeting scheduled for December 9, <br />2002. Mr. Mihalkanin asked if Council decides to modify this proposed <br />Ordinance, would the entire process have to begin again. Mr. Mark Taylor <br />stated no, the Council can modify the Ordinance as is so chooses. Mr. <br />Taylor asked how many illegal signs might exist. Mr. Patterson stated <br />there are probably a dozen, which might be illegal. Ms. Narvaiz stated if <br />the current Ordinance is not enforced, then what will the new Ordinance <br />accomplish. Mr. Patterson stated the new Ordinance will allow Staff to <br />follow up on enforcement if an illegal sign comes to their attention. Mr. <br />Mayhew stated he is interested in looking at ways the Council may want to <br />amend, but supports the proposed amended Ordinance as it is written. Mr. <br />Mihalkanin moved to table the Ordinance until the next Regular Meeting <br />scheduled for December 9, 2002, and Mr. Mayhew seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration an Ordinance on emergency, <br />the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE 2002-2003 CITY BUDGET TO PROVIDE FUNDING FOR THE NORTH <br />IH-35 WASTEWATER IMPROVEMENTS PROJECT¡ AND DECLARING AN EMERGENCY. <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency, and Ms. <br />Tatum seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration reconsideration of a <br />Zoning Ordinance.
