Mr. Mihalkanin moved for approval of an Ordinance on second reading, and the remaining two Resolutions, by consensus, and Ms. Tatum seconded the motion, which passed unanimously. The captions of the Ordinance and Resolutions read as follows: Approval of Ordinance on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY'S 2002-2003 BUDGET TO TRANSFER FUNDING FROM THE DAVIS LANE/AQUARENA SPRINGS DRIVE C.I.P. PROJECT TO A PARKLAND AND RECRATIONAL FACILITIES ACCOUNT¡ REMOVING THE PARKLAND RESTRICTION ON A PORTION OF THE OLD SEWER TREATMENT PLANT PROPERTY IN THE 1300 BLOCK OF IH-35 NORTH¡ AND DECLARING AN EFFECTIVE DATE. Adoption of Resolutions: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE SUBMISSION OF APPLICATIONS FOR FUNDING FROM THE TEXAS DEPARTMENT OF TRANSPORTATION ("TXDOT") THROUGH THE "SAFE ROUTES TO SCHOOL" PROGRAMS¡ APPROVING THE CITY'S EXPENDITURE OF LOCAL MATCHING FUNDS¡ AUTHORIZING THE CITY MANAGER TO ACT ON THE CITY'S BEHALF WITH REGARD TO THE SUBMISSION OF THIS APPLICATION¡ AND DECLARING AN EFECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AGREEMENT BETWEEN THE CITY AND THE LOWER COLORADO RIVER AUTHORITY FOR A TELECOMMUNICATIONS COLOCATION AGREEMENT¡ RATIFYING THE EXECUTION OF THIS AGREEMENT¡ AND DECLARING AN EFFECTIVE DATE. Mayor Habingreither introduced for consideration Item 10 removed from the consent agenda, remove from table and adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 1,448.06 ACRES, MORE OR LESS, LOCATED OFF OF IH-35 NORTH, NORTH OF THE BLANCO RIVER, INCLUDING THE CHAMPIONS CROSSING AND SADDLEBROOK SUBDIVISIONS (NORTH IH-35 TRACT) ¡ APPROVING A SERVICE PLAN FOR THIS TRACT¡ INCLUDING PROCEDURAL PROVISIONS¡ AND DECLARING AN EFFECTIVE DATE.
