Mr. O'Leary stated this property would still need to be annexed. <br />Ms. Tatum stated she did feel the Staff should move forward with this <br />annexation. <br /> <br />Mayor Habingreither introduced a discussion regarding the disannexation of <br />the Southwest San Marcos area. Mr. O'Leary reviewed the suggested process <br />of the disannexation. He stated Monday, December 2, 2002, the Council will <br />hold a public hearing from 5:30 to 8:00 at the Activity Center and adjourn. <br />Then the Council will come to City Hall and hold their Regular Meeting at <br />8:30. On December 9, 2002 the Council will hold a discussion and give <br />staff direction for the disannexation process. Mayor Habingreither stated <br />he would not like to see a public hearing scheduled for the first week in <br />January. Mr. Mark Taylor stated the Council would need to complete the <br />disannexation process so the election precinct boundary lines can be <br />adjusted. Mr. Mihalkanin stated he wanted a process with the division of <br />the Southwest San Marcos area so it could help Council to look at the cost. <br />He stated he wants these divisions to be done in the subareas the Council <br />has already discussed. Mayor Habingreither inquired whether any of these <br />areas could stand alone. Mr. Mayhew asked if the December 2, 2002 Workshop <br />would be televised. Mr. O'Leary stated Time Warner will tape and televise <br />at a later date, and Staff will contact Grande as well. Mr. Mihalkanin <br />stated at the Regular Meeting on December 9, 2002, he would like a <br />discussion item in letter order of the sub areas A-F. Mr. O'Leary inquired <br />whether the Council wanted to look at all of the Southwest San Marcos area <br />or none of the areas or sub areas. Mr. Mihalkanin stated he felt the <br />Council should not consider the all or nothing approach but just areas. <br />Mr. O'Leary stated the Council does not want to look at all of the <br />Southwest San Marcos area. Mr. Mihalkanin stated he felt the Council might <br />end up looking at the entire area after the individual areas are reviewed. <br />The consensus of the Council was to look at the sub areas A-F. <br /> <br />Mayor Habingreither introduced a discussion regarding possible amendments <br />to the City's Clean Air Ordinance. Mayor Habingreither stated there are <br />citizens who have signed up to speak during this agenda item. 1) Alvaro <br />Garza stated he was the President of the Downtown Association and the owner <br />of the Smoothie Shop. He stated he is an advocate for health, but does not <br />feel the need to strengthen this Ordinance. He feels business should be <br />able to decide whether they want to be smoke-free or semi-smoke free. 2) <br />Grant Jacobs stated he is part of the San Marcos Hospitality coalition. He <br />stated he feels if the Council strengthens the Ordinance, the bars would <br />lose revenues. He stated he feels people have the right to choose. 3) Tom <br />Rowe stated he owned a Bail Bond Company in San Marcos. He feels the <br />Council should leave the Ordinance as it is now. 4) Allen Manning stated <br />he was the owner of the Triple Crown. He stated there are 47 smoke-free <br />restaurants in San Marcos and an additional 37 restaurants have designated <br />smoking areas. He felt there was no need to change the Ordinance. 5) <br />Nettie Hartsock stated she felt the Council needed to establish a fair <br />playing field. She stated she wanted the right to breathe clean air. She <br />also stated as a citizen of San Marcos, she expected the Council to protect <br />everyone's health. She asked Council to strengthen the Ordinance. 6) <br />
