<br />61. <br />Regular Meeting <br /> <br />December 9, 2002 <br /> <br />Page 6 <br /> <br />REVISING FEES UNDER SECTION 86.197 OF THE CITY CODE FOR METER <br />TAMPERING, METER TESTING AND METER INSTALLATION; REVISING SECTION <br />86.198 OF THE CITY CODE TO AUTHORIZE CUSTOMER-SIDE SERVICE CALL FEES <br />AND REPEAT-LINE LOCATE FEES AND SETTING THE AMOUNTS OF THESE FEES; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Mayhew moved for approval of the Ordinance on first reading and Ms. <br />Narvaiz seconded the motion. Tom Taggart, Director of Water and Wastewater, <br />stated this proposed Ordinance is to change the deposit and fee amounts. He <br />stated the proposed changes are from $60 for both Water and Wastewater to <br />$50 for each and a $50 deposit for irrigation systems. There are also <br />miscellaneous service fees changes such as Tampering fee from $40 to $100 <br />and Meter test fees from $15 to $35 and a newly established Customer side <br />service call fee of $20. This proposed Ordinance is to also increase the <br />City installed water meters from $50 to $60. This fee was developed for the <br />service calls which are determined problems on the customer's private <br />property and for second calls for the same problems. There is a Repeat Line <br />locate fee for customers who call a second time for a utility line locate at <br />the same service location within 90 days. Mr. Taylor inquired as to the <br />length of the deposits being held. Rodney Gonzales, Director of Finance, <br />stated for the customers who have a 12-month history of paying on time, <br />their deposits are returned upon request of the customers. Mr. Montoya <br />inquired whether the City waives the fees for fixed incomes and seniors. Mr. <br />Gonzales stated he would check into the waiving of the fees for seniors. <br />The City does have a deposit assistance program for low to moderate income <br />people, and in addition, people are not required to pay deposits if they <br />have a good paYment history at another utility company. The Council then <br />voted unanimously for approval of the Ordinance on first reading. <br /> <br />Mayor Habingreither introduced for consideration an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 86.026 OF THE CITY CODE TO PROVIDE FOR INDIVIDUAL <br />METERING AND SUBMETERING OF USES CONNECTED TO THE CITY WATER SYSTEM; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Mihalkanin moved for approval of Ordinance on first reading and Ms. <br />Narvaiz seconded the motion. Mr. Taggart stated this proposed Ordinance <br />puts the City in compliance with the Texas Legislature which required <br />individual metering for apartments and condominiums built after January 2003 <br />to provide measurement of the quantity of water. He stated this does not <br />effect existing apartments unless they elect to submeter. Then Council then <br />voted unanimously for the approval of the Ordinance on first reading. <br /> <br />Mayor Habingreither introduced for consideration removal from table and <br />approval of an Ordinance on first reading, the caption which was read as <br />follows: <br />
