No one did, so Mayor Habingreither closed the public hearing. <br />Mayor Habingreither stated the first reading is scheduled for Regular <br />Meeting held on October 28, 2002. <br /> <br />Mayor Habingreither introduced a public hearing regarding an Ordinance, the <br />caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 1,448.06 ACRES, MORE <br />OR LESS, LOCATED OFF OF IH35 NORTH, NORTH OF THE BLANCO RIVER, <br />INCLUDING THE CHAMPIONS CROSSING AND SADDLEBROOK SUBDIVISIONS (NORTH <br />IH35 TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; INCLUDING <br />PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither <br />speak. No one did, <br />Mayor Habingreither <br />the Regular Meeting <br /> <br />opened the public hearing and asked if anyone wished to <br />so Mayor Habingreither closed the public hearing. <br />announced the first reading is scheduled to be held at <br />on October 28, 2002. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on second reading, the captain which was read as follows: <br /> <br />AN ORDINANCE AMENDING CHAPTER 86, UTILITIES, OF THE CITY CODE BY <br />REPEALING DIVISIONS 4 AND 5 OF ARTICLE 3; AMENDING IMPACT FEES FOR <br />WATER AND WASTEWATER FACILITIES; ADOPTING UPDATED LAND USE ASSUMPTIONS <br />AND AN UPDATED IMPACT FEE CAPITAL IMPROVEMENTS PLAN; AMENDING IMPACT <br />FEE SERVICE AREAS FOR THESE FACILITIES; PROVIDING FOR COLLECTION AND <br />ASSESSMENT OF IMPACT FEES; PROVIDING FOR OFFSETS AND CREDITS AGAINST <br />IMPACT FEES; PROVIDING FOR ACCOUNTS FOR IMPACT FEES AND USE OF FUNDS <br />IN THESE ACCOUNTS; PROVIDING FOR APPEALS, RELIEF PROCEDURES AND <br />EXEMPTIONS; PROVIDING FOR FUTURE UPDATES; PROVIDING FOR AGREEMENTS FOR <br />CAPITAL IMPROVEMENTS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />Mr. Mayhew moved for the approval of the Ordinance on second reading and <br />Mr. Mihalkanin seconded the motion. Mr. Mayhew moved to amend Section 4. <br />Definitions K. to read New development ... New development includes the <br />conversion of an existing use from on-site water or wastewater facilities <br />to the use of city water or wastewater facilities and to amend the Exhibit <br />6 Schedule 2 to read Properties platted prior to June, 1990 and after the <br />effective date would pay the $1,100/$900 rates and 2) properties platted <br />between June 1990 and the effective date of the ordinance would pay the <br />$363/$547 rates; and Mr. Mihalkanin seconded the motion, which passed <br />unanimously. Mr. O'Leary stated the Engineering Department is presently <br />working on the City's Water Master Plan. Ms. Anderson, Director of <br />Engineering, stated the Council is planning to revisit the Impact Fee <br />Ordinance after September 30, 2002. She suggested the Council revisit the <br />Impact Fee Ordinance after the Engineering Department finishes the Water <br />and Wastewater Master Plan, so they will have better figures on future <br />growth. The Council agreed on consensus to revisit the Impact Fee <br />
