<br />111. <br />Special Meeting <br /> <br />September 25, 2002 <br /> <br />Page 2 <br /> <br />26, 2002 should not be played out in the public and press. <br />stated Sac-n-Pac's insurance company has attempted to handle <br />with Ms. Tatum fairly, equitably and with integrity, and Mr. <br />to let Sac n Pac and their insurance company speak with her. <br /> <br />Mr. Brumley <br />this matter <br />Tatum refuses <br /> <br />Mayor Habingreither introduced for consideration adoption an Ordinance on <br />third and final reading, the captain which was read as follows: <br /> <br />AN ORDINANCE AMENDING CHAPTER 86, UTILITIES, OF THE CITY CODE BY <br />REPEALING DIVISIONS 4 AND 5 OF ARTICLE 3; AMENDING IMPACT FEES FOR <br />WATER AND WASTEWATER FACILITIES; ADOPTING UPDATED LAND USE ASSUMPTIONS <br />AND AN UPDATED IMPACT FEE CAPITAL IMPROVEMENTS PLAN; AMENDING IMPACT <br />FEE SERVICE AREAS FOR THESE FACILITIES; PROVIDING FOR COLLECTION AND <br />ASSESSMENT OF IMPACT FEES; PROVIDING FOR OFFSETS AND CREDITS AGAINST <br />IMPACT FEES; PROVIDING FOR ACCOUNTS FOR IMPACT FEES AND USE OF FUNDS <br />IN THESE ACCOUNTS; PROVIDING FOR APPEALS, RELIEF PROCEDURES AND <br />EXEMPTIONS; PROVIDING FOR FUTURE UPDATES; PROVIDING FOR AGREEMENTS FOR <br />CAPITAL IMPROVEMENTS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />Mr. Mayhew moved for adoption of the Ordinance on third and final reading <br />and Mr. Taylor seconded the motion. Mr. Taylor requested an overview of <br />the Impact Fee Ordinance. Mr. O'Leary stated the formulas to set fees have <br />changed and are based on a 50% evaluation on expected capital improvements <br />over the next ten years. The 50% level is approximately $4,700.00, and the <br />Planning and Zoning Commission approved this. The Council has set this fee <br />at the 1990 level, which is $1,100.00 water/$900.00 wastewater impact fee. <br />If property is in the City the fee when connected will be $363.00 <br />water/$527.00 wastewater. Mr. Taylor stated he was concerned with what <br />apartments pay and whether increased cost of water could be part of the <br />impact fees. Mr. O'Leary stated he did not think it could be but he would <br />be looking at our options.
