<br />185. <br />Regular Meeting <br /> <br />November 4, 2002 <br /> <br />Page 8 <br /> <br />to modify the current Ordinance, and people have the right to choose what <br />businesses to go into or not. Mayor Habingreither stated he feels this is <br />a personal freedom and the Ordinance should remain as is. Ms. Tatum stated <br />she feels there should be some revisions. Mr. Mayhew stated he feels there <br />should be revisions and likes the New Braunfels' Ordinance. Mr. Taylor <br />stated he feels the Ordinance should not be revised, but if the Council is <br />interested in revising, then there should be some modifications to allow <br />certain business to be exempted. Mr. Montoya and Ms. Narvaiz both stated <br />they feel the Ordinance should be revised. Mr. Mihalkanin stated he feels <br />the Ordinance should not be revised. Mr. Mayhew stated he likes the idea <br />of smoke-free restaurants and would like to recommend wording and bring <br />back to the Council at the Regular Meeting on November 25, 2002. Council <br />agreed by consensus. Mr. Mihalkanin stated he feels the Council Members <br />who feel the current Ordinance should be revised should provide the changes <br />to the City Attorney. <br /> <br />Mayor Habingreither introduced a discussion regarding update on Wonder <br />World Drive Extension and Overpass Projects. Sabas Avila, Assistant <br />Director of Engineering, gave the Council an update on the Wonder World <br />Drive Extension Project. He stated this is a three-mile project from <br />Hunter Road to Ranch Road 12. He stated the biggest obstacle is the <br />sensitivity of the environment. He stated the environmental assessment is <br />almost completed and then the assessment will be sent to Texas Department <br />of Transportation, who will review it. Mr. Taylor inquired whether the <br />project is still on schedule. Mr. Avila stated a large cave was found <br />which caused the environmental assessment to be revised, and the assessment <br />should be completed by April, 2003. After the assessment is completed, the <br />City will be subject to regulatory laws and timetables, which will push <br />this schedule for acquiring right-of-way back to next summer or early fall. <br />Mr. Taylor stated the citizens of San Marcos find this issue of high <br />urgency and inquired whether there is something the City can do to move <br />this along. Mr. Avila stated Staff has done everything possible to help <br />speed the process up. Mr. Taylor asked Staff to keep Council up to date on <br />this project. Ms. Anderson, Director of Engineering, gave the Council an <br />update on the Wonder World Drive Overpass. She stated she would like to <br />invite Don Nyland with the Texas Department of Transportation to come and <br />speak to the Council regarding this issue. She stated TxDOT has moved this <br />project date back to September, 2004. She stated appraisals are being <br />done now and the City will need to buy a track that consists of 1.7 acres. <br />She stated there will need to be utility relocation and right-of-way <br />acquisition, which will be the biggest issue. Mr. Mayhew stated he noticed <br />two new billboards, which recently went up in this area. Ms. Anderson <br />stated TxDOT is acquiring the right-of-way where these billboards went up, <br />and there was nothing in place to prevent these billboards from going up. <br /> <br />Mayor Habingreither introduced a discussion regarding items to agendize for <br />November 21, 2002 Joint Workshop with San Marcos CISD, Hays County, <br />Southwest Texas State University and the City. Mayor Habingreither stated <br />he would like to discuss the school district's planning process for placing <br />new schools. Council agreed by consensus. Ms. Tatum stated she would like <br />
