<br />~~gular Meeting <br /> <br />September 23, 2002 <br /> <br />Page 2 <br /> <br />gasoline spill accident at the San-n-Pac Diamond Shamrock store in San <br />Marcos. Gasoline from the hose on the gas pump showered allover Martha <br />and inside her car, while her son watched. He stated he received a <br />horrifying call from Martha to come take her to the emergency room. He <br />then contacted the Chief of Police and the City Manager to inform them of <br />the incident. He stated he was genuinely concerned about the accident scene <br />and the possibility of an explosion and putting the public in further risk. <br />There was no emergency vehicles dispatched to the scene, nor was the <br />accident scene isolated to protect the public. In fact the store was <br />allowed to continue selling gas. He stated on Wednesday, September 25, 2002 <br />the City Council will be holding a Special Meeting, and on behalf of the <br />NAACP, he would like to hold a public hearing in connection with this <br />accident. He stated he has requested a copy of the accident report and a <br />copy of the hazardous clean-up report, which he has not received. Mr. <br />Tatum stated he felt the system had failed to protect and render aid to his <br />family in an effort to protect the financial interest of the company and <br />the apparent economic liability of the City of San Marcos. He stated San- <br />n-Pac's insurance company contacted Martha within hours of the accident. <br />Mr. Tatum stated after the accident he went on a fact finding mission. The <br />biggest issues for him were, why 9-1-1 was not called and why this incident <br />was notreported openly and honestly to the public. He stated his wife is <br />the Deputy Mayor Pro Tern and the third highest ranking official in this <br />City and the highest ranking African-American female in the entire Hays <br />County. He feels more should have been done to protect his family and the <br />public. Mr. Tatum requested the Council strongly consider his request, <br />because he has accumulated facts and pictures and no longer wants to deal <br />with this issue behind the scenes. He stated he is continually being <br />harassed by insurance companies. Mr. O'Leary stated he, Chief Griffith and <br />the Fire Department did respond to the scene and found no hazardous <br />material on the ground, and Sac-n-Pac was repairing the pump. Mr. O'Leary <br />stated he would give this report to Mr. Tatum. 3) Dianne Wassenich stated <br />she wished to speak on item 5D Planning and Zoning Commission appointments, <br />and item 6 Impact Fees. She stated she feels these appointments are <br />important. She stated it makes it difficult in the Planning and Zoning <br />Commission meetings when members have some financial interest. She <br />encouraged the Council to keep this in mind when they appoint new <br />Commissioners. She stated on the Impact Fees the taxpayers do not want to <br />pay for the cost of growth. On tracking water costs in the area, she feels <br />apartments should pay the same costs as Single-Family homes. 4) Matthew <br />Harrison with the Bennett Realty Group stated he wished to speak on Item #8 <br />regarding the IH 35 North annexation. He stated he had distributed a <br />letter to all Council Members in favor of the annexation. He encouraged <br />the Council to pass this annexation. <br /> <br />Mayor Habingreither introduced for consideration approval of one <br />appointment to the Human Development Commission. No nominations were <br />received and this will be rescheduled. <br />
