<br />44. <br /> <br />Regular Meeting <br /> <br />September 9, 2002 <br /> <br />Page 11 <br /> <br />Mayor Habingreither introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to seek the City Attorney's advice <br />regarding pending litigation, contemplated litigation, a settlement offer, <br />or a matter involving attorney-client privilege (Ethics Review Commission); <br />Sections 551.072 and 551.073, to discuss purchase of real property (North <br />IH35 area); and Section 551.074, to discuss appointment of public officers <br />(Planning and Zoning Commission members) and duties of public officers <br />(City Council Members). Mr. Mihalkanin moved the Council adjourn into <br />Executive Session at 10:15 p.m. and Mr. Mayhew seconded the motion, which <br />passed unanimously. <br /> <br />Mr. Mihalkanin moved the Council reconvene at 11:38 p.m. and Mr. Mayhew <br />seconded the motion, which passed unanimously. <br /> <br />The meeting adjourned at 11:38 p.m. on motion made by Mr. Mihalkanin and <br />seconded by Mr. Montoya. <br /> <br />~ <br /> <br />B.\~ <br /> <br />Robert B.
