The motion carried unanimously. <br />(18)MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Porterfield, the City Council voted six (6) for and none (0) opposed, with Mayor Narvaiz having <br />left early, to adopt Resolution 2009-117R, as previously captioned, subject to the contract being <br />brought back to the City Council within 60 days for consideration of added language reflecting <br />possible conflicts of interest. The motion carried unanimously. <br />(19)MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Thomaides, the City Council voted six (6) for and none (0) opposed, with Mayor Narvaiz having <br />left early, to adopt Resolution 2009-118R. The motion carried unanimously. <br />NON-CONSENT AGENDA <br />24. Consider adoption of Ordinance 2009-55, on emergency, amending the City's 2008-2009 <br />budget to authorize the expenditure of funds in the sum of $5,140 for the purchase of <br />replacement TV monitors for the City's government access television station; declaring an <br />emergency; and providing an effective date. <br />MOTION: Upon a motion made by Councilmember Porterfield and a second by <br />Councilmember Jones, the City Council voted six (6) for and none (0) opposed, with Mayor <br />• Narvaiz have left early, to adopt Ordinance 2009-55, as previously captioned. The motion <br />carried unanimously. <br />25. Consider adoption of Ordinance 2009-56, on emergency, amending Section 5 of <br />Ordinance No. 2009-12 to grant the developers of the proposed Purgatory Creek <br />Apartments on Hunter Road an extension of time from September 30, 2009 to June 30, <br />2010 to obtain TXDOT approval of the size and location of a curb cut and construction <br />plans for a center turn lane and deceleration lane on Hunter/Hopkins Road and to obtain <br />final approval and recording of a subdivision plat and approval of a site preparation <br />permit as conditions precedent to the effectiveness of a proposed amendment to the official <br />zoning map of the City to change the base zoning from "GC" General Commercial District <br />to "MF-18" Multi-Family District for a 12.743 and 9.761 acre, more or less, tract of land <br />out of the JM Veramendi Survey No. 1, Abstract No. 17, and a proposed land use plan and <br />proposed development standards for the Purgatory Creek PDD, including procedural <br />provisions; and providing an effective date. This item was brought to the beginning of the <br />meeting so that everyone would be present for the vote. Mayor Narvaiz left after the vote. <br />MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember <br />Couch, the City Council voted four (4) for and three (3) opposed, with Councilmembers Bose, <br />Jones and Thomaides voting against, to adopt Ordinance 2009-56, on emergency, as previously <br />captioned. The motion failed due to an ordinance on emergency requires five affirmative votes. <br />• Consensus of the City Council was to bring this back at a Special Meeting before September 30. <br />RM091509 Minutes Page 5
