Mr. O'Leary read amendments Hays/Caldwell Womenn Center $27,575, Neighborhood Cleanups & Junk Car Removal $51,775, SMEU Elderly Energy Conservation Program $11,575, Hays/Caldwell Council on Alcohol and Drug Abuse $6,575, The Greater San Marcos Youth Council $5,925, Nosotros La Gente $2,625, Neighborhood Sidewalk $144,575, Park Improvement $151,575, Sub-standard Structure Removal $58,575, Cephas House Acquisition $54,575, Southside Rehabilitation Program and Price Senior Center $33,575. Mr. Mihalkanin moved to amend as read by Mr. O'Leary and Mr. Taylor seconded the motion. On roll call the following vote was recorded: AYE: Mihalkanin, Habingreither, Taylor. NAY: Narvaiz, Mayhew. ABSTAIN: None. The motion failed. Mr. Mayhew stated he was not comfortable with making changes at the last minute. Ms. Narvaiz stated next year she would like a breakdown of costs the City incurs to administer the CDBG program. The Council then voted unanimously for the adoption of the Resolution. Mayor Habingreither introduced a discussion regarding investigation of campaign flyer. (1) Colonel Mike Dishman stated several citizens who would like the campaign flyer investigated have approached him. He encouraged the Council to seek help for the Federal and State level with the investigation. (2) Ray Kotowski stated he feels the Council should dismiss this campaign flyer and get on with the business of the City. Mr. Mihalkanin stated he agrees with Mr. Kotowski but feels the campaign flyer does violate the law. He encouraged the Council to direct the appropriate staff members to ask the Secretary of State and the U.S. Department of Justice for assistance with the investigation. Ms. Narvaiz stated she wished to discuss this issue in Executive Session. Mr. Mark Taylor stated Council could adjourn to address in Executive Session and give direction to Staff in public. Mayor Habingreither stated he feels the campaign flyer should be investigated. Mr. Taylor stated he feels everyone in San Marcos is a victim of this campaign flyer and agrees it needs to be investigated. Mr. Mayhew stated he thinks the campaign flyer is disgusting, but feels the City needs to move on in a positive manner. Mayor Habingreither introduced an Executive Session pursuant to the Government Code, Section 551.071, to discuss the campaign flyer. Mr. Mihalkanin moved the Council adjourn into Executive Session at 9:37 p.m. and Mr. Mayhew seconded the motion, which passed unanimously. Mr. Mayhew moved the Council reconvene at 10:10 p.m. and Mr. Mihalkanin seconded the motion, which passed unanimously.
