Mr. <br />Mihalkanin moved to amend as read by Mr. O'Leary and Mr. Taylor seconded <br />the motion. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Habingreither, Taylor. <br /> <br />NAY: <br /> <br />Narvaiz, Mayhew. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />The motion failed. Mr. Mayhew stated he was not comfortable with making <br />changes at the last minute. Ms. Narvaiz stated next year she would like a <br />breakdown of costs the City incurs to administer the CDBG program. The <br />Council then voted unanimously for the adoption of the Resolution. <br /> <br />Mayor Habingreither introduced a discussion regarding investigation of <br />campaign flyer. (1) Colonel Mike Dishman stated several citizens who <br />would like the campaign flyer investigated have approached him. He <br />encouraged the Council to seek help for the Federal and State level with <br />the investigation. (2) Ray Kotowski stated he feels the Council should <br />dismiss this campaign flyer and get on with the business of the City. Mr. <br />Mihalkanin stated he agrees with Mr. Kotowski but feels the campaign flyer <br />does violate the law. He encouraged the Council to direct the appropriate <br />staff members to ask the Secretary of State and the U.S. Department of <br />Justice for assistance with the investigation. Ms. Narvaiz stated she <br />wished to discuss this issue in Executive Session. Mr. Mark Taylor stated <br />Council could adjourn to address in Executive Session and give direction <br />to Staff in public. Mayor Habingreither stated he feels the campaign <br />flyer should be investigated. Mr. Taylor stated he feels everyone in San <br />Marcos is a victim of this campaign flyer and agrees it needs to be <br />investigated. Mr. Mayhew stated he thinks the campaign flyer is <br />disgusting, but feels the City needs to move on in a positive manner. <br /> <br />Mayor Habingreither introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to discuss the campaign flyer. Mr. <br />Mihalkanin moved the Council adjourn into Executive Session at 9:37 p.m. <br />and Mr. Mayhew seconded the motion, which passed unanimously. <br /> <br />Mr. Mayhew moved the Council reconvene at 10:10 p.m. and Mr. Mihalkanin <br />seconded the motion, which passed unanimously. <br />
