<br /> 2.5. <br />Regular Meeting March 25, 2002 Page 6 <br />Mayor Chiu introduced for consideration removal from the table and <br />adoption of an Ordinance on third and final reading, which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> AMENDING DIVISION 3 OF ARTICLE 3 OF CHAPTER 34, ENVIRONMENT, OF THE <br /> SAN MARCOS CITY CODE TO ADD REGULATIONS PERTAINING TO NOISE FROM <br /> VEHICLES AND FROM PARTIES IN RESIDENTIAL AREAS; INCLUDING PROCEDURAL <br /> PROVISIONS; PROVIDING FOR PENALTIES; AND PROVIDING AN EFFECTIVE DATE. <br />Ms. Hughson moved to remove the Ordinance from the table and for adoption <br />on third and final reading, and Mr. Cox seconded the motion, which passed <br />unanimously. Mayor Chiu asked how the disconnection of the electricity <br />would be handled. Chief Griffith stated he has drafted a strict policy <br />procedure for all Officers to follow and the Officers at the scene will <br />have to get a second opinion from a Supervisor before any action is taken. <br />Ms. Hughson made a motion to amend Recital 1 to read, "The City staff <br />residential areas of the City disturb the area residents, <br />detrimentally.. .", and Mr. Mihalkanin seconded the motion, which passed <br />unanimously. Ms. Hughson moved to amend Section 34.090 Definition of <br />Residence to read "Residence means... sidewalks and streets insofar as the <br />activity in common areas lS a continuation of activities inside the <br />residence,lI and Mr. Mihalkanin seconded the motion, which passed <br />unanimously. Ms. Hughson moved to amend Section 34.093 Notification (a) to <br />add "by email", and Mr. Mihalkanin seconded the motion, which passed <br />unanimously. Ms. Hughson moved to add a subsection (d) to Section 34.095 <br />to read, "It is a defense to prosecution under subsection (c), for a <br />property manager, that the property manager has been instructed by the <br />property owner not to address the nuisance situation,lI and Mr. Mihalkanin <br />seconded the motion, which passed unanimously. Ms. Hughson moved to <br />strike "h~ve moved to ~ different reoidence" in Section 34.100 (a) (3) and <br />(c) (3) and insert "no longer occupy the residence", and Mr. Mihalkanin <br />seconded the motion, which passed unanimously. Ms. Tatum stated she would <br />like the Council to receive a report from Staff whether or not this <br />Ordinance is working effectively. The Council then voted unanimously for <br />adoption of the Ordinance on third and final reading. <br />Mayor Chiu introduced for consideration approval of minutes of the Regular <br />Meeting held March 4, 2002, approval of two Ordinances on second reading, <br />adoption of one Ordinance on third and final reading, and adoption of <br />thirteen Resolutions by consensus. Mr. Mayhew moved for the approval of <br />minutes of the Regular Meeting held March 4, 2002, approval of two <br />Ordinances on second reading, adoption of one Ordinance on third and final <br />reading, and adoption of thirteen Resolutions, and Ms. Tatum seconded the <br />motion, which passed unanimously. (Mr. Mihalkanin and Ms. Hughson <br />abstaining from Item 27.5 adoption of Resolution regarding an Agreement <br />with Southwest Texas).
